I think Cruz sees the issue and understands that a strong action is needed. But, he is a strong defender of the constitution and has opposed the idea of executive action to implement policy.

I think he also knows this is an opening bid for Trump, a negotiator who knows you always start asking for more than you expect to get. In making this statement Trump knows it will put congress on the spot, weaken both Obama and Hillary and give him wall to wall coverage once again with no money spent.
