Their very first argument in a class action suit would be that they as a group have 'standing' for a complaint under the Constitution, probably Amendment 14 equal protection clause.

Not sure it would be a class action but equal protection would certainly be the argument, and they would probably prevail.

They’d start out in as individual cases in EVERY Federal District. The SC would then aggregate them by picking the case with the best argument and hear that one and let the decision apply to all of them. So, it would be class-action in the end.
