President Obama said Monday that he is âconfidentâ that new gun control measures he will roll out this week through executive order will not violate the Second Amendment.
Obama, speaking to the press before meeting with Attorney General Loretta Lynch, added that he had âgood newsâ: the recommendations from his administration on how to enact new gun control measures would be within his legal authority.
âThe good news is that these are not only recommendations that are well within my legal authority, and the executive branch, but theyâre also ones that the overwhelming majority of the American people, including gun owners, support and believe in,â Obama said. âSo over the next several days weâll be rolling out these initiatives. Weâll be making sure that people have a very clear understanding of what can make a difference and what we can do, although we have to be very clear that this is not going to solve every violent crime in this country.
âItâs not going to prevent every mass shooting. Itâs not going to keep every gun out of the hands of a criminal. It will potentially save lives in this country and spare families the pain and the extraordinary loss that theyâve suffered as a consequence of a firearm being in the hands of the wrong people. Iâm also confident that the recommendations that are being made by my team here are ones that are entirely consistent with the Second Amendment and peopleâs lawful right to bear arms, and we have been very careful recognizing that, although we have a strong tradition of gun ownership in this country, that even those who possess firearms for hunting, for self-protection and for other legitimate reasons want to make sure that the wrong people donât have them for the wrong reasons.â

Thomas Sowell has written about these types of statements. There is no definable measure of success or failure. You can't prove that someone's life was spared or someone suffered less as a result.
The only thing that will become evident is its encroachment on the Second Amendment.

I think Obama is going to go with the “As long as it doesn’t touch a firearm, it doesn’t violate the Constitution” gambit.
In other words, licenses, bullets, registrations are all fair game.

Well, the 2nd Amendment clearly says that “Congress shall make no law...”. It doesn’t say anything about the President, so technically he is correct. It won’t violate the 2nd Amendment, it will violate Article I, Section 1 of the Constitution, which vests lawmaking powers ONLY in the hands of Congress.

Oops, that is the 1st Amendment that mentions Congress, isn’t it? The 2nd is more general. So I guess he’s violating the 2nd, and Article I, and probably the 10th Amendment as well.

That must be in the US Constitution 2.0. I've never read any such language in the 2nd Amendment in the present US Constitution. It's in the 1st. But the 2nd says "SHALL NOT BE INFRINGED." Government infringes that right every day, so they might as well change the Constitution.
