Does Cruz use the word “eh” (ex. “Nice day, eh?”). If he does, he’s Canadian. Simple as that.

That link says Ted’s mother became a Canadian citizen along with her husband during the 8 years residing there.

Seems like Canada could clear this up.

The “original” SR511 definition of NBC ( http://www.leahy.senate.gov/press/the-introduction-of-a-senate-resolution ) signed by Obama, Clinton, Leahy, Coburn, Webb and McCaskill and verified by Chertoff, states very plainly that NBC means born in the USA of two US citizen parents. The SR511 that Congress vetted McCain with ( https://www.govtrack.us/congress/bills/110/sres511/text ) is a watered down version but still states TWO US CITIZENS.

There is a reason Leahy has kept the original version on his website all these years.

That question would seem to be the basis for any potential legal complications initiated by Hillary and the DNC. The issue isn't necessarily how courts would decide, but whether it would cast doubt in the minds of the electorate.

In Obama's case, whether or not his Hawaiian "birth certificate" was forged, he at least claims to have been born in the U.S. We know his father was not a U.S. citizen at the time of his birth, so once again the question hinges on the mother's citizenship status. By the line of reasoning advanced here, as long as Ann Dunham was a U.S. citizen at the time of Obama's birth, it's irrelevant whether he was born in Hawaii, Keyna, or the on the moon.

My mistake. What he has released has the same (limited) effect though. His Birth Certificate gives the place of his mother's birth as Wilmington, Delaware.

I agree with that, and that was essentially my point. Her citizenship status at her birth isn't a relevant inquiry.

Your framing of the issue is interesting too - it implies that a dual citizen mother and non-citizen father are sufficient basis to confer NBC status to a child born outside of the US. IOW, it implies that renunciation of US citizenship is required to relinquish the claim.

That would have been dumb. She may have become a permanent resident (landed immigrant status) in Canada, which would have left her an American citizen with the right to return and live here as a citizen.

Do you have the slightest comprehension or understanding that “that link” was simply to some random person’s “timeline” that he/she put together? Do you actually believe everything you believe on the internet? Why should “Canada” clear up some random internet poster’s ramblings? Have we lost all sense of proportion about this issue and this primary race.

That's quite the excellent question. From my knowledge on the subject, the answer would have to be - no.

While most people realize there are 2 types of citizenship - naturalized and Natural born, few realize there are 3 types of Allegiance - adopted, Natural and local.

The local Allegiance creates the residency requirement of 'in the country', so in the case of someone with parents of differing Allegiances, that local Allegiance would mean the child's Natural Allegiance would be to the parent whose country they were living in.

Kind of a 2 against one type of thing.

Thanks for your post, so I don’t have to rehash this. There is a very clear distinction between BHO’s case and Ted’s that made BHO’s birth place extremely relevant and Ted’s not. It’s all about the mother’s qualification to confer U.S. Citizenship at the time of her child’s birth. Ted’s mom qualified, BHO’s didn’t.

If more Freepers understood this and would read the excellent Harvard law review treatise on the natural born citizen (link given earlier in this thread) then we could put this canard to rest and focus on the real substantive differences between the candidates.

So if Canada decides that everyone in the US is now a Canadian citizen and that they all lose their US citizenship....that doesn’t mean sh@t.

To lose your US citizenship you have to renounce it via the US channels. US allows dual citizenship so unless she contacted the US and renounced her citizenship she is still a US citizen.

He has said numerous times about the non criminals that he wants to expedite them back.

He said that they all have to go back. That he will build a wall. That the "good ones" can come back.

"Can come back"? You misrepresent what he says. He says he wants to "expedite" the good ones back!

And the "good ones" are the non criminals, because they are the only ones Trump mentions other than the criminals which he says can't come back.

Whatever is enacted, if anything, will have to go through Congress and be signed by the President. Or they don't return at all, and existing law continues to be operative.

You don't think that McConnell and Ryan will sign off on a legalization amnesty for the multitudes who aren't criminals?

In any event, you misrepresented, and continue to misrepresent, what he said. We get it. You love Cruz. Go vote for him and let's see what happens. Stop making false statements.

I haven't misrepresented a thing. And we understand that you adore your Donald Trump, but you should stop misrepresenting what Trump says and you should stop being so sensitive when I point out that Trump talks like he wants a legalization amnesty.

At present, all FOIA (Freedom of Information Act) requests filed in search of any U.S. citizenship documents to confirm the true official U.S. citizenship status of Ted Cruz have been denied access. All citizenship records for Ted Cruz are sealed unless and until Ted Cruz agrees to allow any such records to be released by either U.S. or Canadian agencies.

The constitution doesn’t address dual citizens. I used to think being a dual citizen was a problem, but the US can’t control what other countries consider citizens. What if China decides the whole world is a citizen of China. Does that mean everyone is no ineligible to be POTUS?

What may mean more is if Ted Cruz after the age of 18 traveled on a Canadian passport or things such as that. But the mere fact that another country calls him a citizen doesn’t mean anything.

Harvard is full of it (again)

The authors cite to the Naturalization Act of 1790 and ignore the fact that the Naturalization Act of 1795, with the lead of then-Rep. James Madison and with the approval of President George Washington, repealed it and specifically changed "shall be considered as natural born citizens" to "shall be considered as citizens of the United States."

James Madison the "father of the Constitution" changed the wording from "natural born citizen" to "citizen". Madison was no dope and the change was to prevent a foriegn born from becoming Commander in Chief. But this also serves to illustrate that "citizen at birth" does not mean "natural born citizen".

There are three types of citizenship
* Natural Born Citizen, two citizen parents born on soil (exceptions for foreign born if parents are abroad in service to country)
* Citizen by birth, foreign born to citizen parent(s)
* Naturalized citizen, a person made a citizen by statute.
