Trump to Cruz: Settle eligibility question or 'get out' of the race

Donald Trump stepped up his attack on Ted Cruz on Monday, tweeting that the Texas senator needs to "either settle his problem" of having been born in Canada or leave the race.

"It's time for Ted Cruz to either settle his problem with the FACT that he was born in Canada and was a citizen of Canada, or get out of race," Trump tweeted Monday morning, on the heels of Fox News polls released over the weekend that showed him with double-digit leads over Cruz in both Iowa and New Hampshire.

Trump has insisted over the course of the last month that Cruz needs to tackle the issue of his eligibility because he was born in Calgary, Canada, despite Cruz's assertions that he is eligible based on the fact that his mother was born in the United States. Cruz renounced his dual Canadian citizenship in 2014, a fact that Trump has frequently pointed out as cause for concern.

I’ve skipped some of the pages of this, and I’m no legal expert, but I know Trump has not sued or threatened to; some Democrats have or threatened to. I only ask - do we want to take a chance like this?

Many here on FR were also very happy that Roberts was appointed. His judicial record was pristine and we were all betrayed by the healthcare tax.

Fortunately for Cruz the plantiff asked for expedited treatment. If Cruz also asked for it to be expedited, it could probably be resolved quickly. But my guess is that Cruz will swat it down on standing or some other technicality the way Obama fought off all of his, and the way Rubio is trying to fight his.

The Florida gent won a dispute, I think it was patent rights over an invention. The Chinese company was judged to pay him $25M. Cruz then represented the Chinese company filing against the judgement. Fox News Channel & CNN have all the details. Check it out!!!

Factis: Ted Cruz is in political freefall, after the Glenn Beck Endorsement at his rally this past weekend. Beck went on, ranting & raving about himself, barely mentioning Cruz, until the end of his “Jim Jones” ego rant about himself (Beck). Do not know what Ted Cruz was thinking when he let Beck loose. This guy Glenn Beck is a full blown looney tune!!! Methinks, Cruz, himself did himself in, IMHO!!! I now actually believe that Marco Rubio will finish ahead of Ted Cruz in Iowa, with Trump claiming th number one spot & getting a good sized victory!!!

The Twentieth Amendment, Section Three places the burden of proving eligibility squarely on the President Elect. If he/she fails to qualify, Congress must name an interim President.

So, how does Cruz not qualify?

In your mind, what must he do to qualify?

First, he must have a valid birth certificate in order to prove age, place of birth and parentage. Since Obama apparently has no such thing except for the forged pdf, he was unable to prove anything and thus has never met the qualify portion of the Constitution. This means that he has never been a legal President because the eligibility requirements clearly forbid those who fail to qualify from holding the office of President. It doesn't matter how the failure to qualify occurred, it's still a failure to qualify.

In the case of Cruz, the question would be how those opposed to his taking office would interpret the natural born citizen question. If they take the traditional view of having to be born of citizen parents and born in a location under United States jurisdiction, he would not be allowed to serve. This is the central question concerning whether or not he is worth taking the chance to elect in the first place. My opinion, based upon the change made to the language of the Naturalization Act of 1790 by the Act of 1795, is that he would NOT be ruled as eligible.

He has that. And a certificate issued by the State Department attesting to his American citizenship.

And that's all he needs to prove his eligibility.

In the case of Cruz, the question would be how those opposed to his taking office would interpret the natural born citizen question.

Aside from voting their conscience, those opposed to his taking office don't have a say in the matter.

Regardless of whether Trump wins in Iowa or not, the case seems to imply that Cruz FAVORS a Chinese company over an American.

I would have to say that this claim is hyperbole at best.

The intent is obviously to associate Mr Cruz with the poor sentiment felt towards lawyers in this country and the anger at Chinese trade and copyright infringement.

There is no way to gauge Mr Cruz’s involvement in the case except that he did do some work on it.

Before he ran for Senate, Cruz was a member of the law firm that represented the Chinese company that hired them.

I guess what people want is for Cruz to ignore his law firm’s accepting the Chinese client and not work on the case at all.

This for me, is much ado about little. It does nothing to prove that Cruz will not have America’s interest in mind if and when he becomes President.
