Lawsuit Over Eminent Domain Could Snarl Bush Library Plans (Flashback 2006)

The school favored to host the George W. Bush Presidential Library, Dallas's Southern Methodist University, may encounter a snag next week in the form of a lawsuit alleging that the school has improperly seized local homes in order to secure land for the proposed library site.

Amid increasing outrage among Republicans over the use of eminent domain and other coercive measures to obtain private property for public projects, a case in Dallas County's 134th Civil District Court, which is set to begin on Tuesday, will determine whether the university violated its legal obligations to local homeowners in an effort to secure the land currently occupied by the University Gardens condominium complex, a potential library site.

"They're taking my home," said Gary Vodicka, one of the litigants and a University Gardens owner and resident, yesterday.

What Trump tried to do would have been better for the community and less intrusive than a vanity project that will generate no tax revenue and gobbles up acres.

It still was not a "public use" project, which is what the Constitution requires for eminent domain.

If the Republicans are so upset about Kelo where has the constitutional amendment draft been to overturn it?

A number of GOP controlled states have passed statutes to limit the effect of Kelo in their states. And there have been several bills introduced into Congress to overturn Kelo, but they have all been killed by Reid and the Dems in the Senate.

Okay. Then that calls the use of eminent domain into question. But it is still the university, not the Bush family that is the one using eminent domain, and they are still the ones that will profit, not the Bush family.

If a private company cannot use eminent domain, then there will never be a factory or manufacturing plant ever built again. Oh sure, they can be built in the middle of the Mojave desert (if the environmental wacko don’t stop it), but factories need to be where the people are to get employees.

I’m not for companies being able to roll over individuals, but there has to be a compromise, using common sense. Especially if we really want jobs and companies to come back to the US. If we’re happy with becoming a 3rd world country, then we should make it as difficult as possible for companies.

I don't know if a presidential library falls under public use either. It is a non profit but not really a govt entity.

Laws can't overrule a court decision like an amendment does.

I am against the Kelo decision but the Trump case predates that by a decade.

And it seems the same people bringing this up to take down Trump don't want to bring up the keystone pipeline that will take private land to build a private pipeline owned by a Canadian company.

Mr. Evans is co-chairman of the selection committee, along with Mr. Bush’s brother, Marvin Bush, and the third member is a Bush cousin, Craig Stapleton. Three of Mr. Bush’s top advisers - White House Chief of Staff Andrew Card, deputy chief of staff Karl Rove, and White House Counsel, Harriet Miers - are also helping the selection committee.

That old woman was offered a million $ by Trump. She turned it down, then the city condemned the shack and she wound up with less than half that amount. Trump wasn’t greedy, she was!

I think the majority of car assembly plants built in the south in recent years used eminent domain. These have helped transform many areas of the south for the better. If factories return they won't be built in the north but in the employer friendly south.

As a couple people have said a couple times, it’s a private University. And I’m on my phone at the coffee shop waiting for work so iIcan’t do much research, but iIcan’t see the founders using emm domain for a library or school. Major roads, as that’s not something that can just be moved a block over. But either way iIdisagree with it. If your property isn’t really yours, are you really free? Complete security in your own property should be a founding cornerstone of our Republic.

AND somehow she is better off standing hard against parking lot and having to live in the cesspool known as Atlantic City, in some propoerty neighboring the incessant activity around a casino?

Why would it have been some great harm to her to have used the proceeds from being “imm domained” out to move to some quiet peaceful suburb with no AC crime or mayhem.

Trump touched on the realities of being forced to give up the property fight, it does come with compensation to the person being moved. Yeb and the other clowns have no real clue of this reality.

She turned it down

The house sold at auction in 2014 for $530,000 (with inflation/opportunity costs, she got 1/4 for it today, then she would have when Trump wanted to buy it)

Carl Icahn bought the property and leveled quickly after he got the deed. I have a feeling he did that so nutjobs won’t try to “preserve” the “historic” Crack house

The point isn’t what she was offered. The point is that she wanted to live in the same house she had lived in for 30+ years. Not sell out to a developer.

So if the government wants to condemn a farm because the farmer does’ want to sell to a condo developer or a at Corp that is OK?

Listen, smart guy...EMINENT DOMAIN is in the constitution and I’ve done more to fight for property rights than you can imagine so stuff it! I don’t like the Kelo decision, but you are just silly. And your silly insults show how ignorant you are.

Cruz’s man Roberts doesn’t mind the kelo decision...you know the CRUZ pick who gave us Obamacare!

Tell that to Cruz’s good friend and scotus recruit John Roberts, who does not object to the Kelo decision. He says the congress still has the power to regulate Kelo, if they choose to.
