But WE THE PEOPLE can FORCE and COMPEL our State Assemblymen and State Senators to sponsor and pass our State Joint Sovereignty Resolutions with Arrest Provisions that leads up to a long transitional period of State NULLIFICATIONS of ALL unlawful spending and usurpation that exceeds their State “DELEGATED” powers and spending PRIVILEGES with all other powers and spending are by Constitutional Law “reserved to the States respectively, or the people”. - TENTH Amendment
In the meantime Congress is using their hired thugs to attack the Sharp family RIGHT NOW, to shut up Victoria.

This is laughably thin legal gruel. The Founders would have been gobsmacked by the audacity of the US Attorneys in arguing for this stuff.

Jefferson-- yes. Washington, I'm not so sure. He had people sentenced to death for the Whiskey Rebellion. (Fortunately, he was out of office before the sentences were carried out. Adams commuted the death sentences to life imprisonment, and then Jefferson pardoned them.)

I'm not talking about the one-paragraph charge against the Oregon folks. Someone wrote that up overnight, I'm sure. I'm talking about the 32-page, six-count criminal complaint against Cliven Bundy, which I linked to upthread. That is not a hastily-written legal document-- too many names, dates and details for that. My guess is that the charges were written up a while back, but the feds saw all the support that Bundy had from locals and were afraid of the reaction if they brought the case then. When Bundy left Nevada to go up to Oregon, they saw their chance and pulled this out of a drawer.

As I said, I have no inside information, and this is all speculation on my part. But as to the patience of the government, I sometimes do criminal-tax defense, and I've seen clients indicted a day or two before the statute of limitations ran.

Let me add, having litigated civil and criminal cases against the IRS, DOJ and SEC, in my experience the federal government is often malicious, but its lawyers are rarely retarded-- there is a lot of competition for those prosecutors' jobs.

That's true. I'll agree with THAT assessment.

The business of the "impeding" felony is still garbage.

I was party to discussions in a previous life where the principals acknowledged that it was an option, but hesitated about going there. The Hammer was too big.

As a libertarian, aren't you concerned about the now-vast and ever-growing body of Federal criminal statutes that apparently can be bent to any end, looking at this case?

not ONE SINGLE politician got involved to address the occupiers concerns, nor did they even mention it at any recent time........ anyone with clout needed to assist them in their cause. No one came to their aid.

I noticed this a few years ago. If you're a Conservative, or just a non-Liberal, and you're targeted, nobody is coming to your aid.

As much as we complain about Liberals, they have each other's backs. Look at all the Liberal power players that got involved with Trayvon Martin and in Ferguson, MO.

This issue is one of the big reasons nobody trusts the GOP establishment anymore. It absolutely will not come to our aid.

Look at Bush when he was president. That assclown let one of his own senior staffers get crucified and go to jail over a BS fake scandal. (Scooter Libby)

He let those two border patrol guys get sent to prison,only pardoning them on his way out of office.

He allowed multiple liberal politicians smear the U.S. military, calling us Nazis and war criminals.

And the list goes on and on and on......

Our side really needs to fix this. We can talk about "Patriot" this and that, but an average Joe really needs high profile support when being targeted. We need help!

Abso-freeping-lutely. And as a lawyer, I scream about it in court whenever I'm defending someone. Not too many judges listen, unfortunately.

The early Republic didn't countenance legions of full-time government prosecuting attorneys, with blank checkbooks.
