REPORT: Ted Cruz Entered US Illegally in 1974
The Gateway Pundit ^ | 2/12/16 | Jim Hoft

Posted on 02/13/2016 9:12:01 AM PST by Dana1960

Lawrence Sellin, Ph.D. a retired colonel with 29 years of experience in the US Army Reserve, argues that Senator Ted Cruz entered the United States illegally as a child in 1974. His parents failed to file a CRBA form which is required by US law. Ted’s parents did not fill out the required form until 1986.

imo Cruz is a natural born citizen but dammit!, the issue is not going to go away until the Supreme Court rules on it. If no one else will bring a lawsuit, Cruz should. It’s in his best interest.

No! My brother is a natural born citizen. My dad was working in Venezuela for a few years when my brother was born. My parents were both US citizens.

My brother is a natural born citizen just like me even though I was born in Dallas.

[[Yes, a child born to two American parents in the USA does need to bring an official copy of his BC to the passport office to get a passport.]]

Thanks, I thought so- but wasn’t sure- so those claiming that Cruz had to file a CRBA to obtain a passport means he isn’t a ‘constitutional citizen’ doesn’t hold water then it would seem-

Trump's wife has nothing to do with this argument.

Well neither does the natural born American Ted Cruz born of natural born American Eleanor Darragh. But that doesn't stop the Drumbsters from bangin on the bongo does it?

Trump just hates American women and their children.

Cruz probably didn’t get the CRBA (birth certificate) until he got a passport for that high school trip. I don’t see a reason for a ‘70’s-80’s kid needing a second birth certificate for anything else. Mom just used the Canadian one would be my guess. I assume that fact is why he is hiding the CRBA info.

Yes. Sadly, this does speak to his character.

It makes him closer to Barack Obama in terms of honesty about his past. Sad. Obama never was a legit citizen ever. Poor Cruz is just a victim of his mom not getting the documentation early on. He was entitled to be American at birth.

He should have been very honest and showed us his CRBA from when he was 16 and explained the situation. He is hiding it because it just isn’t good optics to have a President who wasn’t officially American until he was 16.

There is no such thing as a "second birth certificate." A CRBA is evidence of citizenship, not of birth.

The facts don’t need CBRA paperwork to substantiate them, as the Birth Certificate does that.

As far as the USG is concerned the CRBA issued by the State Department IS the birth certificate.

That’s one way of seeing it, one would suppose, but just to be clear.it’s not my scenario. It’s the Cruz scenario.

“Fixed” could mean a congressional decree like McCain got. He was born with the ability to be an instant citizen. He chose not to be open about this.

Immigration legislation does not alter the constitutional “natural born citizen” requirement for President.

A child born abroad to one U.S. citizen parent and one alien parent acquires U.S. citizenship at birth …

https://travel.state.gov/content/travel/en/legal-considerations/us-citizenship-laws-policies/citizenship-child-born-abroad.html

Things are a bit more complicated for children born overseas out-of-wedlock to a of U.S. citizen father. See the following reference for details. In particular, the language in the case of legally-married parents one of whom is a U.S. citizen and the other an alien is “acquires,” while in the case of children born to parents who aren’t married is “may acquire.”

Donald Trump affirmed that his lawyers looked this matter over and were satisfied that Cruz is a natural born citizen. But, that was in September. The matter is now political and, I guess, regardless of the facts, it’s all fair game.

With regard to somebody “proving” they meet the qualifications for President, upon a filing, state authorities make determinations. They are under oath to uphold the Constitution and the law. Where there are primaries, they have each put Cruz name on the ballot. In numerous states, objections have been filed against their decisions. All judges who have thus far ruled, have dismissed the objections for lack of standing and/or on the merits. So, all the administrative officials and all the judges agree with what Trump’s lawyers said back in September.

Trump is running a revolutionary campaign. Whether he’s your only choice, your first choice, your second choice, or whether you won’t support him under any circumstances, you have to admit that his campaign is re-writing the book of how to campaign. I honestly wonder about whether he agrees with much of what he says, but the man comes across as absolutely sincere and honest. He is simply an amazing candidate.

“Now what does THIS mean?”

It means that we will have yet another debate tonight in which the elephant in the room will be ignored by the panel:
Is Rafael Eduardo Cruz—former Canadian with a Cuban father and a mother with unclear citizenship, a man never naturalized but invested by his fans with NBC status—eligible to occupy the office of POTUS, the office of VPOTUS, of US senator ... or is he even lawfully residing in the USA?

Another Ivy league, legal beagle IHOP Man of Mystery. Great.

A CRBA doesn't put an end to the issue. It proves one thing, that the circumstances of his birth satisfy the conditions set forth in a statute that grants citizenship. Certain legal conclusions follow from citizenship depending on a statute.

If you look closely to his mother's name on his birth certificate her name ends with ‘Wilson’....why isn't it Cruz? Were Mom and Dad married when Ted was born? or did they get married later on?

This was her previous married name and Mr. Wilson lives in England...England and Canada are under ‘British Rule’ so she wouldn't have to have a passport to travel from England to Canada....

-- It has never been adjudicated. Doesn't mean he isn't a Natural Born Citizen but the particular facts concerning Cruz have never been adjudicated. I lean towards him being a Natural Born Citizen. --

If he had to have his claim adjudicated, he can't be natural born, only naturalized.

This actually makes sense that she filed it late. I couldn’t figure out how he could be a dual citizen with Canada if he had a CRBA filed at the time of birth. Since Canada did not allow dual citizenship at the time.

By 1976, Canada allowed dual citizenship. We know Ted had dual citizenship until a few years ago. So it makes sense that the CRBA was not requested until years later. Canada sent him the final renouncing paperwork of the citizenship conveyed at birth and Ted posted it, but not his CRBA or passport.

If the CRBA was requested much later, then he could be a dual citizen of the US and Canada, but he has been lying all this time. He had to know that he was a Canadian when getting his CRBA and his passport as a teenager. He has been claiming he didn’t know he was Canadian.

Cruz is not a natural born citizen.

He is hiding his CRBA and his passport for a reason.

Go dig thru this article and see if anything makes sense to you.

http://www.dallasnews.com/news/politics/headlines/20130818-ted-cruz-born-a-citizen-of-canada-under-the-countrys-immigration-rules.ece

“If a child was born in the territory, he is Canadian, period,” said France Houle,
a law professor at the University of Montreal. “He can ask for a passport. He can vote.”

The fact that Cruz left Canada when he was 4 doesn’t affect his status there, either.

“If you leave when you’re 2 minutes old, you’re still an American. It’s the same in
Canada,” said Allison Christians, a law professor at McGill University in Montreal.
“He’s a Canadian citizen.”

Having practiced international tax law in the U.S. for 25 years, Christians has made a
close study of citizenship rules. They often come into play in tax cases.

“They can feel as American as they want. But the question of citizenship is determined by
the law of the territory in which you were physically born,” she said. “It’s not up
to the Cruz family to decide whether they’re citizens.”
