Lawrence Sellin, Ph.D. a retired colonel with 29 years of experience in the US Army Reserve, argues that Senator Ted Cruz entered the United States illegally as a child in 1974. His parents failed to file a CRBA form which is required by US law. Ted’s parents did not fill out the required form until 1986.

He continually praises Justice Thomas. I’ve heard him three times extolling Justice Thomas in interviews. The last time was on Hannity. He mentioned Scalia too last time.

Republicans run away from Thomas because the left tarred & feathered him so well. I admire Trump for having the guts to stand up for Thomas.

Your name says you serve or served in the Army. Did you swear allegiance to the Constitution? If so, why are you claiming the constitution (”birther nonsense”) does not matter. The Framers of the constitution thought it was IMMENSELY IMPORTANT. That is why they made a SPECIFIC difference eliminating a citizen, unless he was a natural born citizen, from ever being president and command in chief of the Army.

How can somebody enter the USA in 1974 illegally and magically get citizenship in 1986 without going through the naturalization process?

I’m a naturalized citizen. I know the process. If he’s not naturalized then there’s no issue, just people trying to make it one. There is no 3rd type of citizen.

Was he naturalized or not? yes or no?

I was mentally playing with the minimum “contact with US” requirements associated with the current “citizen-at-birth” statutes. A woman can be born a citizen overseas, have one continuous year of US presence at any time before giving birth (e.g., in the US from age 12-13, or 4-5, etc.), return to her homeland, and give birth to a US citizen.

These days, hospitals have the parents sign the SS forms before the new family leaves. Not much to it. I didn’t do that with my first two, and got the stink-eye over it.

“Cruz indicated that he would only deport those who are apprehended, such as those who commit crimes or are caught by prospective employers without having immigrated legally. Immigrations and Custom Enforcement or Border Patrol agents could also apprehend those along the border.

If you don’t catch em with e-verify or committing a crime....they get to stay? Fake documents ? Good to go people.

I was just thinking. Maybe Ted Cruz’s mother notified the consulate at his birth but never bothered to pick up the certificate like my parents never did for me the birth certificate. It wasn’t until he needed a hard copy to go on an over seas field trip that the hard copy was ordered.

You are incorrect.

In the eyes of the law and the Constitution, Cruz has officially been a natural born citizen since his birth. He did not obtain the official documents which he would need for his passport until 1986. (The laws/ legal policies on this have all been posted above.)

Your driver’s license analogy is misguided. Your argument is like saying his mother did not become his mother until she got his birth certificate.

The fig leaf resolution for McCain was an end run around the requirement in a quid pro quo that the GOP would not question The Usurper.
The GOP had many more ineligible candidates on the bench, Jindal, Rubio, Cruz, Haley.

In their justification for McCain being eligible they cited his two parents being citzens.
He was born in the country of Panama. Still not eligible.

Obama had a foreign national father. So did Cruz.
If one can be anything else when born, one cannot be a natural born citizen.

Born here of citizen parents.
Natural born citizen.

Got it. Yes, that works. Not sure a phone call alone is enough, but there is a procedure that absolutely works to renounce US citizenship. I had assumed you were speaking of a renunciation previously required before (in front of) Canadian officials, as a condition of being naturalized Canadian.

the following has to do with naturalization process - not citzens at birth, however, the concern over the term ‘continuous physical presence’ doesn’t necessarily mean they must not leave the US during this time:

Physical Presence

Applicants are required to show that they were:

Physically present in the U.S. for thirty months within the five year period before applying, or (see legal basis)

Physically present in the U.S. for eighteen months within the three year period before applying in the case of qualified spouses of U.S. citizens (see legal basis)

continuous presence requirement:

This “illegal immigrant” crap is ridiculous, but it reveals another layer of the Ted Cruz - NBC onion which should concern his supporters.

The CRBA is not a citizenship document. You can be a US citizen at birth and NEVER have a CRBA. Without it, it is more difficult to PROVE your citizenship, true, but it would not have been illegal for little Ted to enter the US in 1974 without one.

HOWEVER.

In addition to aggregating other sources of evidence to prove citizenship, a timely application at or shortly after birth proves INTENT on the part of parents for you to live your life as a US citizen. If I were a judge and I had to rule on a complicated NBC case (and this case IS complicated), one of the factors IN FAVOR OF NBC status would be the absence of confusion about what your parents intended for you at the time of your birth.

If it’s true that not-so-young Ted didn’t apply for a CRBA until 1986, it suggests that his parents were uncertain about which citizenship status they desired for him at birth, or even which status would confer the most advantages (remember, Uncle Sam was still giving out scholarships to Danang University in 1970, as any Americans living in Canada then were well aware).

If the parents of a child born abroad showed up at the consulate the next day, saying, “here’s the newest American citizen, we are so proud to get that CRBA”, that’s evidence of INTENT. If they don’t, and in fact wait 16 years, it’s also evidence of INTENT.

Ted Cruz will be out of the race in three weeks, but this new wrinkle does make establishing his NBC status harder, IMO.

In the case of citizenship at birth, soley by statute, the process is nothing more than presenting evidnece to an adjudicator. if the evidence is sufficient to meet the statutory requirements, then citizenship is found. Whatever "illegality" stood before, is erased by legal fiction. A natrualized citizen is as much a citizen as is a citizen born in the US.
