The Justice Department would stall any prosecution of Hillary Clinton until after the presidential election should the FBI recommend she be indicted for using a private email server as secretary of state, former House Majority Leader Tom DeLay tells Newsmax TV.
"If the FBI recommends an indictment, the attorney general will appoint a special prosecutor. That gets this case all the way through the election," DeLay, a Texas Republican, said Monday on "The Steve Malzberg Show."
"That's what I think is going to happen [It would be for] stalling purposes. That's how you get it past the election."

Of course the DOJ has no interest in indicting Clinton. The 0bama regime has far too many scandals, too many violations of the law, and Clinton knows enough of them to destroy 0bama’s legacy. 0bama knows it, too. An indictment of Clinton brings on the old Cold War doctrine of Mutually Assured Destruction.
There is no way his DOJ indicts Clinton.
No one can “recommended” and indictment. You convene a grand jury, present evidence and they decide whether to indict or not. If the FBI is confident in what they have, they can convene one anytime they want, why haven’t they?
If she is indicted and chooses not to remove herself for the running, the Repiblicans should spend every dollar they have on running that commercial day in and day out.
Then of course if this vile woman should actually be elected, no one will dare indict her even though what she did would already have sent anyone else to jail. We can hope that FBI director Comey and others resign in protest as has been rumored but I’m not holding my breath on that.

I agree she won’t be charged to even start the process of submitting the evidence to a grand jury. I still think between Judicial Watch’s upcoming “interviews” of her aides and the letters sent to her aides’ lawyers by the FBI to start their interview process, enough damaging information will surface to derail Hilary’s candidacy.
Assigning a special prosecutor is going to create a media frenzy similar to that leading up to Clinton’s impeachment. Trump will take the lead in demanding to know what is being hidden. Even Bernie the commie is going to change stripes when he see an opportunity to take Hillary out.
