HARRISBURG, Pa. - Texas U.S. Sen. Ted Cruz has won a case in Pennsylvania's highest court that had challenged his eligibility to appear on the state's GOP primary ballot and serve as president.

The state Supreme Court order Thursday upheld a lower-court judge's decision to dismiss the case.

A Pittsburgh resident and registered Republican voter, Carmon Elliott, had argued that Cruz isn't eligible to run for president or to appear on Pennsylvania's April 26 primary ballot because he was born in Canada....

Without Scalia or his replacement the Supreme Court is likely to be tied 4-4 which means the state Supreme Court’s decision will be upheld.

No they had to because they were not Natural Born Citizens of the US. And Neither is Cruz.

Well okay....now we have a court that took the time to rule and not throw out the case due to standing. Will it stick is another issue. I do not support Cruz at all, but now we finally have an answer that is not a weasel answer.

I could see that. They have been very wrong about many things in the past 50 years or so.

So the Constitution is a living document? Original intent means nothing?

Just some more Judges Trump supporters will insult, dismiss, ridicule and try to marginalize.

The more I watch, the more I see Trump supporters behave like leftists. Anyone who disagrees with Trump can expect a response similar to what someone telling a leftist they disagree with the LGBT agenda receives.

Because the citizenship of someone born in Canada to a Cuban or Canadian citizen father and probably an American citizen mother is exactly the same as the citizenship of someone who was born here in one of these United States to two American citizen parents.

Sure, that's obvious to even the most casual observer:

Where do Natural Born Americans come from?
Canada, of course! Duh...?
Yeah, sure, no "truth in labeling" problem there. Nope, none whatsoever.

In fact, not much truth there at all.

But it's very "conservative", just ask anybody, and "conservative" is what matters!

Hmmm...I wonder how a "conservative" would define the word "is".

I gave you the obvious original intent. The first presidents were not born in America. Your misunderstanding of original intent means nothing.

It went be heard until after the election

The wheels of justice move slowly

Its too late for Cruz to ask for an early decision. He should have done that when trump suggested it

So after the court decides to hear the case (even that decision will take time) it will sit in the SCOTUS as a pending case and Cruz and the RNC will be in flux

The RNC will not back him for fear it will not be ruled in his favor and Mr Cruz who is suspect in philandering also will be encouraged to step.down until all.all.facets of his life are settled

Remove the outsider and in steps.John Kasich the soros/bush candidate. Or maybe Rubin will necessitate his campaign.

Its a mess. But it is NOT Trump or his supporters who created it. The blame does not fall on the messenger

You are correct
Merit not standing
All.of or.at.least most of HBO decision were correctly ruled.on standing

Merit ruling by court is Yuuuuuuuge!

GilGil are you not a conservative?
So could I make the same argument that 2 American citizens have a kid in the USA then go live in Saudi for 40 years, is that child eligible to be president?

Can I ask if Trump was the one born in the situation of Cruz would you be on the same side?
Because I see this as a rule but I don’t really have the background of why the rule was made.
IMO the ‘Natural Born Citizen’ does not bother me since there’s plenty of America Haters that easily make the NBC clause.

The U.S. Supreme Court does not issue advisory opinions, ever. Therefore there was never any way for Ted Cruz to bring this issue to the Supreme Court.
That responsibility falls to those who don’t believe that he is eligible.
The Supreme Court refused to rule on Obama’s natural born citizenship status 26 times. I would expect the exact same denials of Writs of Certiorari for Senator Cruz.
It takes four Justices to agree to hear a case. There were never four Justices for Obama’s eligibility.

What difference does it make where their parents were born?

What matters is the citizenship they had to pass on to their children when their children were born.

This is about 'citizenship', not about one's nationality or the family's ancestral home or ancestral nationality.

Think about it. It took a few years for the first children born of the first citizens in this new country to reach the age of eligibility to be POTUS.

The exception clause legally allowed non-Natural born citizens (as there weren't any NBCs at that time, only citizens) to be POTUS until we had made some NBCs and they were old enough to be president.

Does need grounds. Next step if challenged even if challenge is we don’t agree is SCOTUS.

As said above all HBO cases were correctly dismissed because the plaintiff did not have standing. Standing was not challenged. This case moves up on its merits. Something none of the lawyers were able to achieve in BHO cases.

The SC correctly ruled on the standing issues no one brought a case on merit in front of them to argue and decide.

Exciting times we live in!

Do you have links to any info that documents Mama Cruz was a Canadain citizen at any
point in her life or while in residency in Canada? If so please provide them. Thanks.
