N.J. judge hears challenges to Cruz eligibility

A New Jersey administrative law judge on Monday heard two challenges to GOP presidential candidate Ted Cruz's eligibility to appear on the New Jersey ballot, based upon the Texas senator's birthplace in Canada.

The judge, Jeff Masin, didn't decide the challenges to Cruz's eligibility to appear on the June 7 primary ballot, but said he would issue a decision Tuesday. The decision is expected to be reviewed by Lt. Gov. Kim Guadagno, who is New Jersey's secretary of state.

One of the challenges was brought by three South Jersey citizens, and the other by a law professor who lives in Maryland and is running for president as a write-in candidate in New Jersey. Both parties argued that because Cruz was born in Canada, he is not a natural-born citizen, making him ineligible for the presidency.

Cruz's mother was born in Delaware, while his father was born in Cuba. The senator released his birth certificate in 2013.

Shalom Stone, a New Jersey attorney representing Cruz, argued that the citizens - Fernando Powers of Blackwood, Donna Ward of Mantua, and Bruce Stom of Winslow Township - and Prof. Victor Williams didn't have standing to challenge Cruz's candidacy. Stone also said the state didn't have authority to decide the question.

As for "natural-born citizen," Stone said the words in the U.S. Constitution "have meaning given to them by English common law" at the time of their adoption. He directed Masin to his brief for cases supporting Cruz's position.

1. The mother of Trump is foreign born, in Scotland but was a naturalized American citizen when he was born...unlike cruz Sr

2. Trump was born in America...unlike Cruz Jr

3. The parents of a NBC can be born n a foreign country but naturalized American citizens..

4. It is the actually person themselves that MUST be born in America and Cruz Jr wasn’t...

5. keep trying...one day you might wake up in a parallel universe where Cruz Jr was born this side of the border...

How about George Romney? He was born in Mexico, yet somehow he was eligible.

George Romney was never eligible...people complained about him at the time...

He was born in Mexico of parents who were accepted by the Mexican government as immigrants intending to stay..

only a revolution forced them to flee for their back to America when George was about 5 years old...

as a grown up George never acted like he loved America ...

Unlike Cruz Jr McCain was cleared by Congress as eligible...as the Constitution stipulates...

The parents of McCain were both American citizens...unlike Cruz Jr...

Admiral McCain was in the US military sent by our government to serve in the Panama region on a US installation..unlike the parents of Cruz Jr

McCain was born on US soil within a foreign country...unlike Cruz Jr..

As for Barry Goldwater Arizona at that time was US territory...like Puerto Rico is ...you do know that people born in PR, the US Virgin Islands, Guam, American Samoa are American citizens and can be POTUS, right ??? Unlike Cruz Jr Goldwater whose 2 parents were both born in Eastern US states..was eligible...

Unlike Canada, Arizona was part of America...

McCain’s citizenship was transferred through his parents, while they lived abroad.

The same goes for Cruz. If you are to dense to understand that, that’s your problem.

Eligibility does not come from statute or case law. All previous Presidents were NBCs.

Unlike Cruz Jr McCain had 2 American citizen parents who did not reside in a foreign country as private citizens with intentions of staying for life..

The difference is that Cruz had dual citizenship until very recently. That is a difference, and you have to explain that to me. McCain NEVER had dual citizenship.

It is the dual citizenship that is the issue.

Oh that’s right, they don’t exist because he has been a citizen from birth, a natural born citizen.

He was born in the US to two US citizen parents? No.

He needs a CRBA. And if that doesn't exist, he's not even a US citizen.

Of course all these records are sealed but it's a catch22 for Ted. Either his mother filed a Consular Report of Birth Abroad or she didn't meet the requirements for him to be a U.S. citizen. But all those documents are sealed.

Why doesn't Cruz ever publicly make these arguments. It's Obama all over again with Cruz letting his supporters fight it out to keep kicking the can down the road. Big difference between Cruz and Obama though, Obama at lease claimed he was born in U.S.

Thank you for your entry. This particular problem still has a few twists. Your entry about the 14th amendment is based upon birth within the US. Cruz was born on foreign soil to a citizen mother which makes him a citizen as long as he was born within the residency requirements I can’t totally find. So far, I have been able to find the citizen parent must be a US citizen and lived within US proper for a period of at least five years and a certain amount of years post the parents 14th birthday. Wish I could find it all, but the web is murky right now on this topic.

Since you agree Congress had the power to do so, why are you so angry, or try to ignore, the fact that Congress passed a law under which Mr. Cruz meets all the qualifications for NBC status?

Don’t forget, kids. It was Hitlery’s campaign who originally dragged out obunghole’s eligibility. If sCruz is the nominee, Hitlery and her monkeys will be on this like white on rice. Think you’ve heard the last of his eligibility issues? Lol. Think again.

Also, don't forget how many liberal judges are out there who would be thrilled to undermine a Republican nominee to help Hillary.

I have no doubt that AFTER Cruz secured the nomination, Hillary would be filing challenges in all 50 states. What are the odds that she won't get some liberal judge in at least a few of the states to declare Cruz to not be a natural born citizen and deny him a place on the state ballot? Pretty darned good.

And, don't expect the supreme court to bail Cruz out. In it's current 4/4 state, it will deadlock over any appeals (if they hear the case at all).

Can Cruz win if his name isn't on the ballot in 5 states; if his name isn't on the ballot in PA, OH, or FL?

The only saving grace is we'll finally get it through to people that there is a difference between "natural born citizen" and "born a citizen".

Without doubt, it’s because Cruz’s mother listed her nationality as Canadian on the birth certificate.

Why? Because, she would not have had access to Canadian government medical benefits had she not been a Canadian citizen.

According to the Cruz campaign he became a Canadian citizen in 1973

Cruz Sr. was not a Cuban refugee but a permanent legal resident of the US. Even if such a program existed, it would not have made Cruz sr. a Canadian citizen immediately - more likely he was given permanent legal status which could eventually lead to citizenship
