New Jersey judge: Ted Cruz eligible for presidential nomination

A New Jersey judge has ruled that Texas Republican Sen. Ted Cruz meets the constitutional requirements to be president and may appear on the state's presidential primary ballot.

Judge Jeff Masin ruled Tuesday that a child of a citizen-father or citizen-mother is "indeed a natural born Citizen within the contemplation of the Constitution."

Why even engage a person who is that far removed from reality? If somebody told me, for example, that the only place the right to keep and bear arms is defended is on FR, implying there is no history, no constitution, no case law, etc., I’d just steer clear. Especially after being told I was deluded.

One of his parents was a U.S. Citizen. That's the test. Canada could proclaim him the Queen of England, we don't recognize Canadian law in this country. My brother was declared a citizen of West Germany, where he was born. He is just as much a NBC as am I.

I have no problems with using an extreme to establish limits and work backwards. I do it all the time; you are in good company there, brother. That’s what I was doing when I asked if it would make a difference of George snuck across the border to, ahem, create the scenario you propose.

What I mean is, folks on the board keep asking about an Iranian or a Taliban fathering a child with an American abroad, as if they couldn’t do it in Michigan. I don’t think an interpretation of a vague clause that is more strict than the interpretation established in 1940 helps our sovereignty. I am all for original intent, but I have read persuasive arguments both ways, and in the end 1940 decides as far as I am concerned. I am open to reading more on the subject though.

our judicial system has determined that there aren’t any requirements to run for president.

So far, the Courts have agreed with the facts and the law (U.S.C. 8 Section 1401). Perhaps the Birther Brigade argument is just all wet. Challenge the law rather that making whining statement. Maybe you will win.

That would make natural born citizenship the most inclusive kind of citizenship ever imagined. The Cruz/Levin people seriously believe that it was what the Framers had in mind with the eligibility clause. To expand the pool of possible presidents worldwide.

Yea you are probably right. The really bad part is the courts are going to re define what natural born means.

The worse part is all of us are going to pay for this blunder.....not just those so deluded.

Your argument is wrong IAW U.S.C 8 Section 1401. You would need to challenge the law, no one have bothered to do that yet, they have just quoted the Birther dogma. How well is that working out?

You are repeating a version of the Birther argument. Eight years on, and that has not gathered any support from those you count. Even the great Justice Scalia thought that the argument was flawed. Maybe someone will agree with you some day

I think that the Constitution is just quite fine so far as the issue is concerned. We ought to have serious concerns about other sections, i.e. the 1st Amendment, 2d Amendment, the 4th Amendment, the 10th Amendment

I believe they use these reasons for the same reason I used George, to drive home the point that leaving the natural born clause open like this can lead to bad things.

You make a great point about those very threats being able to exist in Michigan. You are very correct.

Our immigration system used to ensure assimilation into our country. If you did not want to be an American you didnt get in. But slowly we eroded that protection too.

To where now, as you noted, we can actually home grow natural born citizen terroists so to speak. But that does not mean the answer iis to further erode the natural born clause. (Not that I think you want to erode it further)

I say we need to redouble our efforts at maintaining our national identity. That we should welcome those who come to be a proud American and turn away/kick out those who do not.

That's interesting. I get similar comments, usually from big Trump supporters. Trump is not, and has never been a conservative, but his supporters call me a liberal. Odd, don't you think? For the record, I will support the nominee of the Republican Party: Trump, Cruz, or someone else. The alternative will be to support Clinton or Sanders which I will never do. What's your plan?

I agree with your point. the Birthers believed that the courts would save us from Obama, they didn’t. Now, they want the courts to save them from Cruz, so that Trump becomes the nominee. Just get out there and get your guy elected.
