Mark, they are not bound because rule 16 frees delegates of suspended candidate in the first round.

Mark, Mr. Lawyer... It doesn't matter what the state rules are, because the convention rules, as of now, removed the punishment of faithless delegates in the first round from suspended candidates.

Let me make this easy for you and the media...

So, rule 16(a)(2) says:


(2) For any manner of binding or allocating delegates under these rules, if a delegate (i) casts a vote for a presidential candidate at the national convention inconsistent with the delegate’s obligation under state law or state party rule, (ii) nominates or demonstrates support under Rule No. 40 for a presidential candidate other than the one to whom the delegate is bound or allocated under state law or state party rule, or (iii) fails in some other way to carry out the delegate’s affirmative duty under state law or state party rule to cast a vote at the national convention for a particular presidential candidate, the delegate shall be deemed to have concurrently resigned as a delegate and the delegate’s improper vote or nomination shall be null and void. Thereafter the secretary of the convention shall record the delegate’s vote or nomination in accordance with the delegate’s obligation under state law or state party rule. This subsection does not apply to delegates who are bound to a candidate who has withdrawn his or her candidacy, suspended or terminated his or her campaign, or publicly released his or her delegates.

This subsection is about enforcing state binding rules. It says at the top that a delegate who does not vote as the state directed them to will be discharged, and their vote will be recorded as the state initially directed.

Then it says that the subsection does not apply to delegates whose candidate suspended their campaign, meaning they will NOT be penalized for unbound voting. Since Rubio suspended, this rule says that the penalty no longer applies. If the penalty no longer applies, then delegates bound to Rubio are free to vote for any candidate in nomination without penalty, regardless of what the state rules are. The only option is for the states to reclaim and reapportion the delegates before the convention, like Alaska did.

I believe the rules you cite are the reason individual delegates are not polled. The roll call will be of states and a delegation spokesman will announce the result per state rules. I would guess an individual delegate might protest and have it decided by the Rules Committee, which seems likely to side with the states. We might find out!

Well, Rubio's delegates cannot be compelled to vote for him in the first round if he failed to meet rule 40, so they have to vote for somebody in nomination. That makes them unbound. They can't be compelled to abstain.

So I think that Levin is wrong on this, and so is Rubio. But I do also expect the convention managers to enforce the rules that benefit them, and change or ignore the rules that don't. So Rubio gets to act like he controls delegates that he really does not.

Is that also true of Kasich's delegates, since he very likely will not hit the 8 state majorities per Rule 40?

Rubio has 173. Kasich has 144. That could put 317 in play. Add in those for the other withdrawn candidates is 16 more. And add in the uncommitted, currently 64. That adds up to 397 'loose' delegates. And there are still 789 delegates in states that have yet to hold primaries.

Based on 'hard' delegate count at thegreenpapers.com.

Of course, the Rules Committee is yet to meet for the 2016 Convention and could mullify many of the current arguments.
