I do understand the ‘not fining’ part... where does a private company get to enact criminal punishent to enrich themselves?
I don’t believe that I have given up any rights against unwarranted searches just because I walk into a Macy’s. And I don’t think a Macy’s security guard has any rights to detain me.
Clever editing. Meanwhile the situation that got them busted was they detained a lady, made her pay them to let her go, then had her arrested anyway, and then later charges were dropped. Seems like the right decision. You can detain a suspected shoplifter, but you can’t fine them yourself, and you should probably not be dropping the charges.
If you a guest on private property, you should abide by the wishes of the host. If you do not wish to, and that is your right, don’t be a guest.
This is all about our most basic freedom, Property Rights, when you erode Property Rights, you erode all of our Freedoms.
When you erode our freedoms, you make a mockery of our Independence Day. Do you really want to do that?
In CA they passed a Law that redefined the Felony Grand Theft Statute.
The value of Stolen Goods to Charge as a Felony was raised to $950 from $400 as part of a Non Violent Offender Law.
Now the Thieves make sure to only steal $900 worth of goods at a time so they can only be Charged with a Misdemeanor if they are caught.
My Wife works for a Major Retailer and Thieves walk out of there without fear. You can’t stop them if they get one foot out the door.
So much for Law and Order.
Here’s where the leftist freaks defend this because Macy’s is “insured”.
Like they did when anyone complained about the looting in Ferguson and Baltimore.

I still remember Andy Griffith: The Shoplifters where Andy tells Barney to WAIT until they’re out the door to make an arrest because they can always say they were intending to pay for it.
Send the bill for all of their stolen items to the judge.

Actually, at least in Florida, the law says that setting off a detection device or being observed on video gives the store probable cause to detain you and promptly involve Law Enforcement.

But that is NOT what the TSA does, is it. They treat all people as suspects without Reason and actually destroy our Freedoms. The whole system is based on irrationality (Marxism/fascism).
Now, when they see suspicious behavior, the store and TSA has EVERY reason (along with profiling/using Common Sense) to detain and search. They should be able to access information on all foreigners—profile like Israel has always done for safety.
What the culture is trying to do is remove Reason (Common Sense) from Just Laws-——When Right Reason and Common Sense is removed—there is no possibility of Justice or private property rights.
Remove Right Reason and Natural Law (logic/reason) from our Justice System and you have total irrationality/slavery. Freedom is not possible without the Virtues in the Christian religion and without Reason (logic of Western Civ/Christiantiy) there is no there, there and Up is Down and Slavery is Freedom and Vice is Virtue (in an irrational, Marxist, fascist “world”.

If they refuse, you cannot touch them or the bag and Employees are prohibited from chasing them if they bolt.
However,IMO if a retailer "detains" a shoplifter without convincing proof of the crime (I'm thinking video evidence among other things) that could open the retailer up to a serious lawsuit.
Shoplifters are by definition not customers either...let alone innocent.
Whether a company has the ability to legally detain someone is questionable, but on the other hand these are nothing more than common thieves.
