FBI Director on Hillary Emails: A Person Who Engaged in Similar Circumstances “Would Face Sanctions”
Gateway Pundit ^ | 7/5/2016 | Jim Hoft

Posted on 07/05/2016 10:14:51 AM PDT by GilGil

“To be clear this is not to suggest that in similar circumstances a person who engaged in this activity would face no consequences. To the contrary those individuals are often subject to security or administrative sanctions but that’s not what we’re deciding here. “

When I heard him say that quote, I nearly lost it. It completely negates his lame rationale for not recommending prosecution.

-- You raise an interesting point. I believe this was the main subjective rationale used to avoid prosecution. --

I've been pointing out Comey's duplicity in this. There are "grades" of classified material mishandling, just as there are "grades" of homicide. 793(f) is like 2nd degree murder. Comey talked about the facts not adding up to a 793(f) violation. He talked about that at length. But he also admitted the classified materials were in the wild, a "dead body" if we were talking homicide.

Now, most people are aware that a person who kills another is not necessarily guilty of murder. They can be justified in the killing, or they can be guilty of manslaughter. Manslaughter doesn't require intent to kill, and a violation of classified material law doesn't require intent to give away or even expose secrets. It is enough that the classified material be "out of its secure location."

Enter 18 USC 1924(a), a person who "knowingly removes such documents or materials without authority and with the intent to retain such documents or materials at an unauthorized location" commits a violation.

This is the "manslaughter" variety of classified materials violation. Hillary is guilty of at least this.

Comey did say that the FBI was able to access some but not all of the 31000 e mails that Hillary and her team wiped and indeed that a portion of those e mails were work related and thus not all personal as Hillary alleged. It would therefore seem to me that those e mails should be accessible under FOIA Act she was trying to circumvent when she destroyed them. That perhaps a Judicial Watch request or the FBI turning them over to the Inspector General to oversee their release to the public record may be in order so voters can see what she was trying to hide before the election.

Did the FBI Director not stand up there sweating at the microphone stating she compromised everything?

YES INDEED!

Comey indicted her, sorta. But...unofficially. (I also noticed his sweating. Comey would fail a polygraph spectacularly.)

HE is the one who compromised himself and sold his own soul. And sold out fellow hard-working honest feebs as well as ALL AMERICA.

Now we know: The Law and US Constitution are officially DEAD.

I can't wait to hear Judge Scalia's scathing comments. OH WAIT. He suddenly passed away under very suspicious circumstances WITHOUT an autopsy. Nothing to see here -- move along.

Nothing will change until “we the people” send the clear message that if the laws don’t apply to those at the top they don’t apply to anyone. Followed by “we the people” acting on that message.

Anything less, nothing changes.

You are wallowing in self-pity. Be a fighter, not a defeatist.

On D-Day, our soldiers did not get discouraged climbing those beaches even though they saw many before them fall.

It's easy to be a "woe is me - all is lost" defeatist. Pick yourself and make the best of the hand that you have been dealt. The findings of the FBI is not exactly what Crooked Hillary wanted. Their condemnation of the way she handled confidential emails can and should dog her the rest of the way. Not presidential!

Not basically. He said directly that anyone else would be prosecuted. That man looks like the grim reaper is standing at his back.

I certainly hope that Comey has a large armed guard contingent & that he has an unknown bolt hole to go to.

His life isn’t worth spit after what he declared today.

He has served his purpose for the Democrats & is now expendable.

“How to throw a life away” should be on his tombstone.

Of course she's going to say that. I wouldn't expect anything different even if she was taken away in irons.

It's only on campy TV shows where the villain does the "you caught me" routine at the end, and fully admits his/her crimes (i.e. Batman).

Serial criminals and liars will always proclaim their innocence.

Comey presented as a 'straight shooter' for the previous few months was just to prepare the 'low information voters' for today's announcement.

The fix was in, Obama and Hillary already prepared their joint campaign appearance today AKA "the victory lap".

Exactly

Just like King George started a revolution by using the tactics that our Government is now implementing, so Obama and his minions are doing the same.

And as back on those days, it was blamed on the Founding Fathers for not accepting fascism, tyranny and being treated like beings with no rights or freedoms.
