You Carry Every Day. Do You Know What to do if You’re Pulled Over?
Bearing Arms ^ | 9 Jul, 2016 | Jenn Jacques

It’s happened to most of us – some more than others. You’re driving down the highway or a backroad or maybe you roll through a stop sign one too many times, and here they come. The flashing lights, the piercing sound of the siren. It’s nerve-racking, to say the least.

With so much tension surrounding recent officer-involved shootings, I feel a duty to open the discussion on what to do when legal gun owners either open or concealed carrying are pulled over by police.

No matter what state you find yourself in, national firearms expert and trainer Massad Ayoob explains there is a universal way to inform the officer you’re carrying: hand your concealed carry permit over with your drivers license.

Ayoob is wrong on a heck of a lot of things, yet people still think he is a God when it comes to all things gun. This is a prime example of where he gets it totally wrong.

If you’ve legally purchased a gun it’s already registered anyway. And if you have a CCW they probably figure you have a gun. Most places I go the cops are pro second Amendment types as well.

Colorado as well. BUT when they run your license they will know you have a CCW. It probably is a point in your favor to let them know right away. I keep my permit right behind my license in order to hand both over at the same time. I would rather avoid a problem than start one.

Hold your hands (passengers as well) out the window in plain sight as the officer approaches.

That doesn't sound like good advice. If anything, that behavior would only serve to heighten the tension of the traffic stop not to mention that it would look awkward. Maybe the officer will think you were throwing something out the window like drugs or empty bottles.

Rolling down the window and keeping your hands on the steering wheel seems best. The passenger simply needs to sit still and keep his/her mouth shut. Also, turning the dome light on at night is also good advice. Even though most police cars these days will have a spotlight trained on your car (and you can bet they are recording with a dash cam).

The other poster here saying that you should should answer "no weapons you need to worry about" is unspeakably bad advice. That is almost certain to get you pulled out of the car and unnecessarily lengthen what should be a routine traffic stop. Once you are pulled out of the car, the odds greatly increase that you are probably not getting home for a while.

While not required to disclose in Colorado, they will know as soon as they run your license. I have been told the best thing to do is to hand your CCW with your license. If they want to ask questions they will, if not I would not bring it up. But I would ask their permission before making any moves for registration, insurance etc

May I retrieve it?” and again waited for permission before I moved a muscle.

That’s the way I handle myself too. I get my wallet out of my back pocket and put it in my shirt pocket as I am pulling over. That way I can keep both hand visible at all times when he’s beside the door. I also hang my keys on the window so there won’t be any suspicion that I’m going to make a run for it.

Philando Castile (who was carrying legally and informed the officer)
do you have a link to info verifying this ?

Besides the girlfriend saying it and family members saying it, The Star Tib late yesterday had this assertion from an unnamed source:
Although the names of gun permit holders are not public under state law, a source confirmed Castile was issued the permit when he lived in Robbinsdale.

thanks

I am not the wife of a submariner, not father, brother of one of anyone in the military except my father who served in WWII from 1939 through the duration. I did my time, too, 1968 (drafted) until 1976 in some of the most shit places you could imagine.

All that aside, If you think me calling you something you don’t like, the report me for abuse and call me out. Have them ban me.

I’d gladly give up my 18 years here and my monthly contributions. What I won’t countenance is why I have to kiss some skin head cop’s ass because I have a state law on my side that says I have a RIGHT to a weapon I have a license for and for which I’ve presented a Drivers license and a CWCL license on request. The officer is not allowed to go any further once that license is presented.

I am not married to a ‘submariner’; I was just a certain draftee flunky in 1968 that stuck it out until we lost Vietnam in after 1975. I slaved and paid taxes and worked and slaved for decades afterwards. And for someone to tell me that I have to kiss some skinhead cop’s ass here in Georgia about a weapon I might have after I have shown him a drivers license AND a valic CWCL is beyond the pale.

Get pissed, hit the abuse button and get me banned so I can give up my 18+ years here and finally cut off my monthly contributions. At this point I really don’t give a shit.

Its your 1st and 2nd Amd rights to carry and not say a word to the cops even when asked.

As soon as you give an evasive answer to a legitimate question you have raised suspicion.

“None that you need to be concerned about” only increases the officers scope of what he needs to be concerned about and would get your car searched in Kansas, where as being respectful nice would see you down the road with probly only a warning.

It is all up to you.

>> I am not an asshole by nature and I don’t project that. BUT I DO KNOW MY RIGHTS, BY DAMN.<<

No, NO, NO! When it’s just you and the cop, YOU DO NOT HAVE ANY RIGHTS! You don’t get any rights UNTIL you are standing in front of the judge. That’s when you are suing the cops employer asserting that the dumb, idiotic, crazy cop knew he was violating your rights. If you want to stay alive never argue with a cop!

Yes, but using BLM, the media and the Just-us Dept. logic, there should be at least one person killed by cops in Vermont every week. The question is, Why not?
Is it because Vermont is 94% white?
Is it because, Vermont has no large cities?
Is it because, Vermonters are more law abiding?
Is it because Vermont cops are better trained?

I think most can figure the correct answer(s) to this.

“MY FIRST statement included showing a Drivers License AND a copy of the CWCL. That act preludes them from further intrusion into my civil rights according to Georgia Statutes”

That act does not preclude a police officer from questioning you further regarding weapons you may have in the vehicle. Refusal to provide further information will simply make you look suspicious and escalate the situation. You have already been pulled over for a reason. Perhaps your vehicle is similar to a BOLO description. Whatever. You need to be forthcoming when questioned. Its called common sense.

So the carry permit is coordinated with the drivers’ license. Seems to me they never told us about this. Too bad they never bothered to try to locate illegal guns in the hands of violent criminals.

i asked that question to a detective teaching the legal aspects of conceal carry in Colorado. He said here the driver's license does not indicate a chp. what they do after checking the validity of the driver's license is look up chp in another database.

Howdy, Windy. Good to see you on the board today, fellow Dawg!

You and I both know that all these big talking keyboard commandos, when in this situation, will wise up and do exactly what Gresham and Ayoob advised them to do. FReep is full of armchair ninjas these days, but in the end, they're all hat and no cattle.
