Look, if the Big Guy stepped in on this one, maybe it’s time to listen.

I can live without the death penalty, provided the alternative makes the criminal WISH for death. (with thanks to a FReeper)

I’ll find a vein. I have 40 years of experience and am actually beyond excellent at locating them.

Double jeopardy is trying in a courtroom twice, not trying to execute twice. Nice try.
And he can’t prove “cruel and unusual” without demonstrating intent.

I could be OK with this. They had a shot and blew it.
How difficult is it to kill someone, let the guy’s victims in the door and turn your back.

It is not like he survived electrocution, the chemicals, a firing squad, hanging or whatever and had to actually go through one of those. They just couldn’t find a vein — hardly cruel and unusual punishment.

If he was sentenced to death, and death has not yet occurred, he's still due.
If he was sentenced to go through the execution process once, and only once, he should be able to spend the rest of his days in a cell.

I can’t believe I am about to write this, but... If you can’t kill someone in the course of two hours, I’m sorry, you had your chance and blew it. I say commute the bastard’s sentence to life w/o parole and be done with it.
On a side note this is not the first time lethal injection has taken an unacceptable amount of time to gain the end result. It should be abolished and we should go back to hanging. Even when that is botched it doesn’t take more than ten minutes to kill someone by strangulation. And done correctly it is one of fastest and most humane forms of execution. The British had hanging down to a science. The whole thing typically took less than a minute from the time the hangman entered the condemned man’s cell to the moment the trap was released.

cruel and unusual punishment? the failure to find a vein is unusual, but unintentional. It’s not cruel, it’s not as if he were in prolonged agony and didn’t die, the execution was halted when needles could not be properly inserted.
double jeopardy? No, he’s not being tried again.

Double jeopardy. The state botched the execution. No do-over, and life in prison with no chance of parole for the condemned.

It’s time to end this macabre farce of “lethal injection.” If the state and its minions don’t have the guts to use bullets, ropes, or the guillotine, they should let the offender rot.

executioners failed to find a usable vein following 18 attempts to insert needlesThere's a big one in the center of the chest, just to the right of the sternum. You can find it easily with a #30.06.

I’m surprised at the number of respondents here who are liberal on this issue. Just an observation. They agree with the liberals that you shouldn’t be able to execute him because the first attempt failed. I find that interesting on a conservative site such as this one.

Personally, I can, as an alternative to capital punishment, live with a sentence of life with no chance of parole which, to me, would be a perfectly-adequate substitute. The main reason that I hold on to the death penalty is because the Left never understands the meaning of the term "life imprisonment," so they essentially force their opponents' hands toward the extreme position of the death-penalty as the maximum punishment. Now, given that this person fully-suffered a botched execution, I would not be opposed, in this particular case, to a natural life sentence instead.

I like the idea of multiple execution attempts on the same convict. Prolongs the agony.
We need a Russian Roulette Execution system, where the convict never knows if today is the day. Let him squirm in fear multiple times before the mechanism lines up for a score.

On a beautiful Sunday afternoon in the midst of the French Revolution the revolting citizens led a priest, a drunkard and an engineer to the guillotine. They ask the priest if he wants to face up or down when he meets his fate.
The priest says he would like to face up so he will be looking towards heaven when he dies. They raise the blade of the guillotine and release it. It comes speeding down and suddenly stops just inches from his neck. The authorities take this as divine intervention and release the priest.
The drunkard comes to the guillotine next. He also decides to die face up, hoping that he will be as fortunate as the priest. They raise the blade of the guillotine and release it. It comes speeding down and suddenly stops just inches from his neck. Again, the authorities take this as a sign of divine intervention, and they release the drunkard as well.
Next is the engineer. He, too, decides to die facing up. As they slowly raise the blade of the guillotine, the engineer suddenly says, "Hey, I see what your problem is ..."
