Yes and no. The district court judge ruled that it was, but district courts are not the final word on whether something is constitutional or not. The city appealed and requested a new judge, which was granted. But when de Blasio was elected the city dropped its appeal so the case never went any further.

But, according to liberals the SCOTUS is, and they ruled it Constitutional 50 years ago.

Wouldn't that make it "settled law"?
