My guess because it’s a native reservation the Feds have to be the ones to give the ROE. States usually have little to say in those.

I suspect that it is because it involves a large body of water (the lake), which is, by definition, a "navigable body of water" in the United States. The Corps of Engineers has engineering authority over such. The Corps does quite a good job when they are allowed to (often prevented by politics). I grew up in South Louisiana literally surrounded by ACOE projects (lower Mississippi levee system, Morganza Floodway, Old River Control Structure, the Bonnet Carre Floodway, and more).

Sometimes they get it wrong, but more often the politicians get involved and over-ride the engineering judgments.

Interesting article, showing that the envirowhacos don't really care about the environment.

They caused and set up to be caused far more pollution then the pipeline ever would:

Massive cleanup underway after Dakota Access protesters leave behind environmental mess

Clean-up crews are racing to clear acres of debris at the largest Dakota Access protest camp before the spring thaw turns the snowy, trash-covered plains into an environmental disaster area.

The U.S. Army Corps of Engineers announced Friday that the camp, located on federal land, would be closed Feb. 22 in order to “prevent injuries and significant environmental damage in the likely event of flooding in this area” at the mouth of the Cannonball River in North Dakota.

“Without proper remediation, debris, trash, and untreated waste will wash into the Cannonball River and Lake Oahe,” the Corps said in its statement

The Indian communities get so much free. So much. They can literally get a free education, free healthcare, free housing, and money every year(in some cases monthly). Just because they are native American. On top of what Casino owners give back to their communities which is a lot. For their entire lives.

Yes, but they have taken on a role of an environmental “enforcer,” which seems to be way outside their mission. The way they operate here in Northern California, they can connect your toilet bowl to a “navigable waterway!”

I suspect the difference is "were assigned" rather than "taken on". They are the ARMY Corps of Engineers, after all. If the Commander in Chief says, "do this", then they go forth and try.

Unfortunately, the stretched definition of "navigable waterways" didn't start with Obama, but with Bush I and his "no net loss of wetlands" schtick.
