Vanity: Is Trump Seeing up Dems on the 9th Circuit Ruling?

Trump knew that the temporary ban on travel from the seven majority-Muslim nations would be challenged legally.

He knew that the Democrats would pick the 9th Circuit (most liberal one) to challenge the travel ban.

Some have suggested Trump has no plan in place to defend the law and the B-team argued it before the liberal 9th Circuit.

But is this all part of Trump's master plan? Is he 3D chess-ing it?

Consider the following:

1. Trump's pick to replace Scalia was approved by 99-0 in the Senate (with votes from Hillary and Obama) and is a lock.

2. Kennedy wants to retire. Laura Ingraham said Trump would get another pick within the next 4-5 months and I assume that's the one retiring, unless Thomas has health issues of which we aren't aware.

3. Ruth Bader Ginsburg is aging and not in good health. She's passing out on the bench (falling asleep) and will be 84 this year.

Merrick Garland was likely nominated so the Democrats can make the case that the "Ginsburg" seat should stay with at least a 'moderate' Obama pick like Garland.

That will be a huge fight. The left will accuse Trump of 'stacking the Court.'

4. Trump's given us the list of 20 picks and now we'll have 19 left after Gorsuch is approved.

IF the 9th Circuit rules against Trump over the travel ban, Trump can make the case to the American people that we need SCOTUS picks that will protect Americans and respect the Constitutional balance of power between the three branches.

So my question: did Trump see all this coming and was it part of his plan?

It seems like Trump is ready to take on the the Lib Judiciary. I found it funny today that Trump was reading aloud the relevant section of The Law. Then he said it was so simple that most underachievers in HS could understand it.

Should the 9th just start making Hit up, they are going to be publicly pilloried and embarrassed. This would just be the first Salvo to soften them up for future attacks on their perfidy.

Trump is a 3-dimensional chess player. Although I can’t see the play I’m confident he’s got this. After it’s over I suspect we’ll be marveling at his brilliant gamesmanship.

He’s my age. Too young to retire although then he and his wife could drive around the country in his huge RV and go to Nebraska football games. Two or three years ago Mr. Mercat and I were camping in an RV campground outside of Tucson and as we were walking around in the dusk and this older black man came around the corner walking his dog. That was my first thought... oh my goodness, it’s Justice Thomas but they I realized he didn’t look like him and had a hat which IDed him as a retired general. We stood and traded banalities and he said he didn’t realize that retirement meant he would be walking small fluffy dogs.

The Senate confirmed Gorsuch 95-0 in 2006 for the U.S. Court of Appeals for the 10th Circuit.

I don’t think there was any way he didn’t realize that he would be taken to court over this. I have read many of his books, and Trump is a very smart, shrewd man. I don’t think any of this surprises him.

Remember during the primaries, when Rubio was accusing Obama of “knowing what he was doing” destroying America? Trump always disagreed and said that Obama and the Democrats where just “not smart.” I think Trump really agreed with Rubio, but realized that it was not a winning message, because it impugned Obama’s voters. So, Trump blamed it on Obama’s naiveté. It worked. It made Trump look good, but didn’t impugn Obama’s voters and reduced the blowback from Obama. There is far more to Trump than meets the eye.

I find it highly likely that Trump is allowing this 9th Circuit fiasco to proceed in order to show how out of control the balance of power is among the 3 branches of the Federal government has become. The judiciary has encroached on the other 2 and asserted primacy. Trump is about to lower the boom and reestablish the proper balance by asserting his dominance in matters that are his responsibility, in spite of what the 9th Circuit (or even the Supreme Court) rules to the contrary.

I suspect that is part of his Master Plan. It’s far past time to split up 9C, it’s much too big. Turn them into objects of ridicule—straight out of Alinsky.

The public may be more amenable to making a major change to the circuit court system after Trump is done with 9C.

And, he may be softening the ground in case he needs to go forward with the order based on solid Constitutional grounds despite an adverse ruling.

I think Trump is genuinely flummoxed. He can’t get his mind around the way the courts are so willing politicize national security.

Nope. He knows how much the courts are politicized especially the 9th Circus and especially on his signature issue. He's just bringing it to light so people living with blinders on over the last 20 or so years can now see. It's a real s*it storm brewing.

What about the poor people who are killed or injured in the terrorist attack. Don't they count in your equation?

They should because lots of people injured and many deaths is a huge downside.

I agree with you. This court has had this liberal activism label and reputation for over 20 years. It is the duty of Congress to have prevented this. They could either abolish the ninth circuit, split it or order it not to rule on presidential executive orders. Have you seen them do this?? Of course not, they don’t do anything except talk about doing something as Trump says they’re all talk no action. I think Trump needs to go on in spite of their ruling making sure everyone knows that they are breaking the law not him and he needs to do it soon or they are going to gum up his whole agenda.

Gorsuch coming out today against Trump’s attack on Robarts will win him Democrat support. There is a lot of 3d chess going on with Trump and his team, Dems are imploding, making lots of mistakes, it’s fun to watch.
