Federal appeals court maintains suspension of Trump’s immigration order

A federal appeals court has maintained the freeze on President Trump’s controversial immigration order, meaning previously barred refugees and citizens from seven Muslim-majority countries can continue entering the U.S.

A panel with the U.S. Court of Appeals for the 9th Circuit upheld the ruling of U.S. District Judge James Robart, who had decided Friday that Trump’s temporary travel ban should be put on hold. The Department of Homeland Security soon suspended all enforcement of Trump’s controversial directive.

The Justice Department, representing the Trump administration, could now ask the Supreme Court — which often defers to the president on matters of immigration and national security — to intervene. The Supreme Court, though, remains one justice short, and many see it as ideologically split 4-4. A tie would keep in place whatever the appeals court decides.

Whatever the President’s next step is, it should be second only to firing the POS lawyer who argued this case on behalf of We, The People.

If that lawyer is representative of the lawyers at the DOJ, we are in trouble. For 8 years it seems that all the DOJ lawyers needed to know was how to attack straight conservatives.

If I were Trump, I may just write an EO every 5-10 minutes and issue each one accordingly. I would overwhelm the 9th by drowning them in paperwork so there is no end UNTIL they are all removed or worse. This bullsh^t needs to be stopped and NOW.

just issue an EO that says we halt ALL immigration (legal or otherwise) until we can get things under control.

I like it.

Up the ante, and THIS time, don't take the bait of some liberal judge who tries to stop him with judicial activism.

The President should just cite the relevant legal references and keep on enforcing the law as he sees fit.

I’m hoping his tweet is an indication that his answer is a new EO in response to the court’s over reach. This time it is much more broad and powerful, along with wording that asserts his plain english right to defend the nations borders without court approval.

If I’m wrong? Well, then we may as well shut down FR, go home, and admit that the Republic is lost.

We are now officially in a constitutional crisis. The court has essentially just overturned statute law, historical precedent, prior Supreme Court rulings, and the Constitution.

It's imperative that the President go on national television with his top cabinet members and read out the relevant laws and constitutional clauses which grant the President the full and unambiguous authority to ban travel from any nation when he feels it's in the national security interest to do so.

The court is in a state of insurrection and must be brought to heel by whatever means are necessary, before our nation suffers harm, due to their malfeasance.

They lean heavily on a literal interpretation of the original order, claiming that the inclusion of US persons in the EO makes it unlikely that the Government's case would prevail, therefore there is no reason to grant relief on an emergency basis.

However, they veer extremely close to claiming that non-citizens have Constitutional rights. Most particularly, they claim that a religious test implicit in the First Amendment has never been shown not to apply to US persons. This is very dangerous territory, indeed.

Almost as problematically, they claim that the states have standing to sue on behalf of their universities, which have standing to sue because of their students and faculties. Also, an extremely alarming claim, IMHO; how long does the chain of standing advocating on someone else's behalf get to extend?.

Finally, they conclude on the basis of a "general public interest." (I guess even they realize how weak their actual harm claims are.) Truly an awful hodge-podge of sophistry. And a Bush appointment went along with it. Disgusting.

Actually, for the last 8 years the DOJ lawyers have been on the golf course.

They haven't defended a damn thing - they just stood aside and let liberal judges steamroll the nation on Obama's behalf.

Just like that idiot, they've prolly all forgotten what the inside of a courthouse looks like, and how to win a case.

This had nothing to do with the DOJ lawyer who argued the case.

These justices, if you read their decision, are completely unhinged in their analysis.

Even if Ted Cruz argued the case, these judges would have ruled this way.

Yep. It also says, as long as you get here illegally, somehow, you are considered a US Person with full 14th Amendment protections.

No court has ever ruled that before.
