Ninth Circuit Court Now Demands It Be Protected From Itself…

Oh, the winning… it’s often too funny. The Ninth Circuit Court of Appeals is now independently, on its own impetus, requesting an internal vote on a full panel en blanc hearing to review its own decision.

Additionally, the full ninth are asking the Trump administration to file an additional brief telling the court why the three member original appeals ruling authority was wrong. In essence, the smart judges know what wasn’t considered, and are now looking for an out.

You just can’t make this stuff up.

President Trump did it this way, I think with the advise of A.G. Sessions, and maybe others, to nail the court, which he has...

They know full well that they ruled ‘politically’ against him and not with the Constitution in mind...this is to show the American People how corrupt the whole government is, and he has been showing us from day one and will not quit until every rock is overturned...

Like I said a couple of weeks ago, fasten your seat belts, this is going to be one wild, fun filled, crazy ride...

But if trump wins at the appeals court and it goes to scotus and splits 4-4, the appelate ruling stands as is.....

I think there is a minority of reasonable, conservative, Constitutional judges on the 9th; I seem to remember a senior judge on the court named Reinhardt (sp?) who really is a commie asshat. 80% of the opinions of the court have been overturned by the USSC and in most of those Reinhardt wrote or co-authored the majority opinion. The problem is the 9th is just too darn big. It really does need to be broken up into at least two circuits.

True....but personally I’d rather see Trump rewrite the a new EO and keep this merry-go-round going. It’ll be fun watching the outrage and the Dimrats argue while Trump plays the game a new way.

You want to cite chapter and verse of the Constitution, followed by precedent, you make your case (pun intended); that *is* their job. But, it should be hammered home that the panel did not rule on the LAW (no mention, no reference, not even a side-ways glance), but ENTIRELY upon F-E-E-L-I-N-G-S and the prejudice of the their own political bent.

IMO, that breeches ‘good behavior’. They wish to be law MAKERS, they won’t\shouldn’t (technically, CANNOT) be doing so from the bench. Congress and the States should be doing more in this area than they have since the Courts self-endowment of ‘final arbiter’ status.

“Chief Judge Sidney Thomas of the 9th Circuit Court has instructed both Trump’s DOJ team and lawyers for the State of Washington and Minnesota to file briefs due by Thursday February 16th, stating whether they believe the motion should be considered en banc.”


This is moving at lightning speed for the Ninth Circuit. On Second Amendment cases, they have taken years to sort them out. Their hair is on fire about something. Just what they plan to do is uncertain, but they want to do it fast.

En banc decisions at the 9th Circuit are decided by an 11 judge panel, that is picked at random, except for the Chief Justice, who is automatically included. In this case it would be Thomas, who is ultra-liberal.

It’s the ninth circuit court. They aren’t going to change it. They want to push it closer to the scotus and attempt to make Trump look bad. That court is not concerned about ramifications. How many liberal elite are these days.

Finally .. the 9th Circuit realizes they have overstepped their bounds .. and THIS GUY FIGHTS BACK ... OMG!

I know most of the time, the others just bow and scrape .. but this time .. HE ISN’T GOING AWAY.

So, the whole group is riding to the rescue (for their own credibility) ..?? Maybe when Trump read the STATUTE THAT GAVE HIM FULL AUTHORITY TO DO WHAT HE WANTED TO DO - MAYBE .. JUST MAYBE .. THEY FINALLY GOT THE PICTURE .. So now, the adults need to come to the rescue.

AND .. THEY DESERVE ALL THE LAUGHTER THEY GET .. LOL ..!!!

IIRC, the full appellate court must review a panel ruling before a case can go to SCOTUS. Some of the cases on 2nd Amendment issues that have been followed closely here in the past have gone through this process.


I believe you are mistaken. Most cases are not reviewed en banc. The Ninth has made it almost required for Second Amendment case to go to en banc, it seems. But en banc used to be considered rare.
