When will these bakers/florists/etc. learn to make up an excuse to refuse service, rather than outright tell them the real reason? It’d save a lot of money and hassle.

Here's the argument I make to my friends with this comes up:

You constantly need to emphasize 'Equal Rights' vs 'Special Rights'

When Donald Trump was elected, numerous Hollywood types (performers & singers) refused to do business with him, because they did not believe in what he stood for.

I tell my friends, the artisan in Peoria, who owns a bake shop, wants that same right - to refuse service to anyone if they don't believe what they stand for.

And when they say, "well what if they didn't want to serve blacks?"; My answer is, 1 - they probably won't be in business too long and 2 - How would you force Hollywood singers to perform for Donald Trump.

When they say, "that's not what we're talking about...,"; you say, "oh you want special rights for some people to sue but not others ... I believe in equal rights..."

There's an easy way to deal with perverts in this kind of situation.If you're a photographer,a baker or a florist you accept the assignment.Take no money from them...assure them that payment can be made later.Then,you make sure that the cake you bake,the pictures you take,the floral arrangements you make are HORRIBLE!.Cake falling apart...pictures horribly out of focus...flowers all dead.

When they complain you apologize profusely and assure them that no payment is due.

Word will get out to the pervert community that your service stinks and you'll never have another one darken your door.

Washington is in full extinction burst mode.

Prices here are through the roof as of Jan 1 too. Between the new minimum wage laws and the raft of tax increases the situation here is pretty terrible.

They need to do it. Use almost dead flowers, bad color combinations, ugly arrangements. The same with cakes or invitations, just do a terrible job. They won’t pay, will try to sue, but just say you did the best you could

The US Constitution does not preclude the states from regulating religious activity. In the first amendment, the founders restricted only Congress from prohibiting the free exercise of religion, not the states — “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; . . .”

The words in the Constitution allow the states considerable freedom to establish laws and rules regulating the conduct of citizens within the borders of a state. The remedy for Christian shopkeepers, who feel their religious freedom is being infringed, lies in amending the state’s Constitution to restrict the state judiciary. If these Christians cannot organize and work their will through the legislative process, their choice is to accept the will of their fellow citizens or leave the state.

We as a nation must return to the rule of law through the legislative process. Allowing judges and panels of judges to write law by imposing their personal preferences on the population needs to end. Legislatures do have the power to limit the jurisdiction of the courts through law or constitutional amendment. Until the people insist the legislatures of the state and the national governments rein in the courts, there will be no relief.

There is a huge difference between refusing to allow someone to buy an arrangement on the shelf and refusing to create art on demand. Even if you think the first should be banned, punishing the second is an act of pure evil. Those on the other side of this debate deserve no sympathy, no compassion, and no consideration. We can morally and ethically do whatever is needed to defend ourselves against this unprovoked set of attacks, as if we were facing thugs trying to enslave us - because these are thugs trying to enslave us.

Unfortunately the court may be right. It is likely the agency that levied the fines is given broad powers by state law to interpret the statute and apply it. If so then the court pretty much has to find they acted within their authority when they applied the law to persecute businesses they believe are in violation of the law.

The court is not the main problem here. Poorly written laws and run away power hungry agencies with a progressive agenda
are.

That is one reason religious freedom protection laws are so important. It is also why it so important that state agencies not be given so much power.
