Judge: Dade Holding Arrested Immigrants For ICE Is Unconstitutional

MIAMI (CBSMiami) — A Miami-Dade judge ruled Friday that county holds of arrested immigrants for ICE is unconstitutional but the debate is not over.

“Yeah, this is a great win. It’s a great win for the Constitution. It’s a great win for individual rights and it’s a judge who’s courageous enough not to be intimidated by the president of the United States,” said attorney Louis Reizenstein.

In his order, the judge said the ICE holds on county inmates violate “the separation of powers between the state and federal governments…(and) the Constitution of the United States….The Federal government is without power to compel state authorities to house… Federal prisoners.”

While the judge ruled against the county, the practical effect of the ruling on arrested immigrants is not yet clear since the county can appeal the decision and they plan to.

Since when has constitutional rights been applied to non citizens? Another example of an activist judiciary reinterpreting and rewriting Federal law.

Come on Sessions. Do your job and have this judge arrested. If I get to ask President Trump a question tomorrow at the rally, my question will be this: You say we should honor the law. Why aren’t you arresting judges and politicians who are breaking it?

I wish Congress would pass a law that every judicial decision that something is unconstitutional, SHALL REQUIRE the judge to cite the provision of the constitution and write a direct and concise statement saying why the action violates that particular Constitutional provision.

A lot more decisions would be shown to be ridiculous on the face of it.
