How About a National Obamacare Waiver? (If Romney could, Trump can)
The Heritage Foundation ^ | May 2011

Posted on 03/24/2017 8:23:32 PM PDT by UnwashedPeasant

To date, the Department of Health and Human Services (HHS) has approved 1,372 Obamacare waivers, covering 3.1 million Americans. Yesterday, The Daily Caller reported that among HHS's most recent round of 204 Obamacare waivers, "38 are for fancy eateries, hip nightclubs and decadent hotels in House Minority Leader Nancy Pelosi's Northern California district." That's right: Nearly 20 percent of exemptions from Pelosi's crowning health care achievement were doled out in her backyard.

If that's not enough irony for you, try this waiver on for size: On Monday, the Las Vegas Sun reported that Nevada—Senate Majority Leader Harry Reid's home state—received a partial statewide Obamacare waiver, too. If you're keeping score, Reid was Pelosi's counterpart in the Senate fighting to get Obamacare passed into law. Now his state will be one of three to get a waiver from the law's requirements, while the rest of America suffers.

Why did Nevada get a waiver? The Sun reports that HHS found that some of the law's implementation requirements "may lead to the destabilization of the individual market." Senator Dean Heller (R-NV) said that that's all the more reason why Obamacare should be repealed:

"It is becoming increasingly clear how flawed this law really is . . . Not only did it cut a half trillion dollars from Medicare, impacting thousands of Nevada's seniors, now the law would have driven health insurers out of our state if a reprieve had not been granted . . . This is why 'Obamacare' will not work for Nevada."
But Pelosi's district and Reid's home state aren't the only ones getting waivers. There are others getting a break from the law, too—big corporations and labor unions.

Romney's plan was "Repeal-by-Waiver" by executive order without the need for Congress to help, on Inauguration Day. ("If I am elected president, I will issue on my first day in office an executive order paving the way for waivers from ObamaCare for all 50 states," said Romney)

Obama gave over 1000 waivers to Democrat allies, including Unions and crony capitalists.

The President clearly has authority to issue waivers ad nauseam. While at it, he can cancel waivers for the Unions.

I’d be for that. Universal and permanent.

We need a ground swell movement to force all federal employees (bureaucrats, congress, judges, staff) on to the 0bamacare exchanges with no special subsidies.

Waivers for every red state... no explanation will be given why blue states are not treated similarly... California and Nevada waivers should be rescinded.

Why then can’t Trump simply issue one universal waiver?

President Trump issued an EO on inauguration day doing some of that.

The order directs agency heads to “waive, defer, grant exemptions from, or delay the implementation of any provision or requirement of the Act that would impose a fiscal burden on any State or a cost, fee, tax, penalty, or regulatory burden on individuals, families, healthcare providers, health insurers, patients, recipients of healthcare services, purchasers of health insurance, or makers of medical devices, products, or medications.”

Now that’s thinking out of the box. I sure hope our President sees this idea. It’s something he can do without Congress. Free people from the mandate and allow capitalism to kick the socialist plan off the map.

There are 3,600 church/religious organizations (I obtained the list from Senator Joe Donnelly's [D-IN] office---Republican's wouldn't get it for me), the members of which are exempt from Obamacare.

Most are Amish and Mennonite groups and churches, but there are some unaffiliated Baptists, independents, and others.

Agreed. “Repeal” Obamacare through executive action to make it easier to repeal the actual legislation.

The remaining insurance companies are hanging on by a thread.

They are right now applying to participate in Obamacare for 2018 (filing deadlines range from April to June, depending on the state).

If they think the mandate or subsidies are at risk, they will drop out of Obamacare faster than Moochelle can eat a donut.

Finally. Folks are looking at how to make this a win. Do blanket waivers, no one buys the insurance. No insurance company offers policies. We end up with a de facto cash and carry system. Basically what our grandparents had. They survived.

That executive order is a good first step, but he needs to explicitly get rid of the IRS extortion mandate for regular Americans, especially now that the Republicans in Congress have decided to keep Obamacare for the foreseeable future. Of course, getting rid of the “tax” without getting rid of the specifics of Obamacare will certainly make premiums go up, but maybe that would be enough to light a fire under the congressmen’s backsides and get them to finally get rid of Obamacare and work to lower health care costs.

He probably can’t. So he simply makes it known that anyone with the slightest reason for wanting a waiver will get one.

Don’t like o-care? Waiver.
Christian? Waiver.
Pagan? Waiver.
Cat has a hairball? Waiver.

Yes. A beautiful thing, isn’t it? What we’ll get is a cash and carry system that works better, and costs less. The big problem will be catastrophic care. Christian sharing ministries will probably pick up the slack to some extent.
