Commerce Clause The Commerce Clause refers to Article 1, Section 8, Clause 3 of the U.S. Constitution, which gives Congress the power “to regulate commerce with foreign nations, and among the several states, and with the Indian tribes.”

Somebody correct me if I'm wrong, but I believe Congress holds the reigns on interstate commerce?

True, but the courts have held that insurance policies are not commerce. They are contracts. The Constitution does not give the federal government power over those.
