Sessions’ New Civil Asset Forfeiture Policy Fares Poorly Among Voters

Attorney General Jeff Sessions’ recent announcement of a new Justice Department directive concerning civil asset forfeiture was panned by critics on the left and right, and a new Morning Consult/POLITICO survey shows most Americans aren’t receptive to it either — regardless of their political persuasion.

59 percent of registered voters surveyed said they opposed the new policy, which expands law enforcement agencies’ rights to seize money and property from people even if they haven’t been charged with a crime. Thirty-seven percent said they were strongly against the proposal, while a quarter of voters were in favor of it.

Fifty-seven percent of Americans said they thought it was a bad idea to allow law enforcement agencies to keep as much as 80 percent of the funds they seize, and 55 percent said the new directive would do more harm than good.

This unconstitutional practice has been going on for quite a while now. George HW Bush, March 05, 1991 =>

Asset forfeiture laws allow us to take the ill-gotten gains of drug kingpins and use them to put more cops on the streets and more prosecutors in court.

In the last 5 years alone, the Justice Department shared over half a billion dollars in forfeited assets with State and local law enforcement.

It's ominous that fully 25% of voters can be that abysmally and irredeemably stupid

A lot of whores depend on the drug war for a living. I'd say that explains a fair chunk of those 25%.

Hard to believe that the entire ooncept hasn't been to SCOTUS yet. One aspect of it did get shot down back in June though. Sessions is really pushing against the trend for some reason.

Asset Forfeiture without a conviction is theft under the color of law. In a perfect world every government employee who has engaged in this practice and convicted for doing so should be put against a wall and shot.

Sessions must go and this policy burned. It is patently illegal, wrong, unethical, immoral, and definitely a sin by any definition. There is nothing in this law to prevent seizure or your property and assets and mine. Fire the AH NOW! He is not an honest broker.

If you amass a sizable amount of money; even over the course of a lifetime, and chance to transport it from one place to another, you risk its discovery and seizure by law enforcement. Their claim will be that the amount of cash is evidence of an illegal act and leave it to you to prove otherwise. In the absence of the seized cash, it may well be beyond your resources to do so. That the police have a strong financial incentive to engage in this behavior is intolerable.

Sessions may as well have come out in support of White Power rallies to be held in each district on the 15th of each month. The only supportable position is to put an end to this abuse of due process, not to strengthen and amplify it.

I agree that is Sessions's intention, and if Sessions himself were in charge of the police in each case, and prosecuted all the cases personally, then it would at least do some damage to organized crime.

However, it is unconstitutional and invites abuse by corrupt LEOs and prosecutors. Furthermore, even if the authorities charge you and you are found innocent, and you actually get your assets back, having them confiscated for so long is disastrous.

Civil forfeiture as practiced is in transparent and direct violation of the "takings" clause of the Fifth Amendment of the Constitution. No conservative worth a spit would support it. Sessions reveals his swamp-loyalty by supporting it.
