Sheriff Joe will appeal this politically-motivated ruling, and this time demand that a jury of peers rather than a lone judge decide his fate.

Appeals courts don't have juries. The only way for Arpiao to get a jury is for his original conviction to be thrown out and to be retried.

I think this will be the basis of his appeal, the original trial should have been a jury trial.

It seems more than just a little Un-American to not be able to get a trial by a jury of his peers.

You are correct. There are no Juries in appeals Court. The point of Sheriff Joe’s appeal is that he demanded a jury trial in the first place and the Judge refused. I know a person has a right to a jury trial unless the defendant waives same. In this case the Judge decided to only charge a misdemeanor for which a jury is not required. Sheriff Joe was basically given a reverse Judge shopping case.
