If so, (depends on how the policy is written) HuffPo’s insurance carrier might not be required to pay for Ali’s defense if HuffPo itself is not a Def.
Sounds like a potentially very smart move on part of Bolling’s lawyers. (They are very much a White Shoe firm.) Ali cannot afford a good defense, and the message herein to HuffPo is that if your insurance carrier starts to pay for Def, we’ll add you as a defendant.

This is especially true, since Bolling is a Public Figure money damages are unlikely, but through Discovery they can effectively make Ali admit he had no story.

The standard here is actual malice. Ali claims he has sixteen sources. And at least one Fox personality already went on the record about Bolling.
Unless he can prove some massive conspiracy with Ali at the center of it, he’s not going to be able to meet the standard.
Doesn’t matter. Unless he had reason to know that all these sources were yanking his chain, it’s not going to be viewed as malice or reckless disregard for the truth.
This is high profile. Ali is going to set up a legal defense fund and/or end up with the best free speech attorneys working bro bono. He’s not going to go broke paying for his defense, whether HuffPo foots the bill or not.
Again, Bolling claims 16 sources, and there is a Fox contributor who just buried Bolling on Facebook. The truth of the story is not at issue here (aside from an affirmative defense). The questions is whether Ali acted maliciously or recklessly here.
I don’t see how Bolling proves that unless there is some memo where 16 women agree to take him out and admit to having a reporter willing to go with the ruse.
I wasn’t aware of that, thanks for the information. Both my parents were daily communicants and I joined them numerous times when I could. That says a lot to me about Eric Bolling.
Actually, in this sort of action, “Truth is the ultimate defense.”
Regardless of Ali’s motives, sources, even commercial enrichment from the story, if the story is true, Bolling has no case.

......I’ve had the opportunity to sue people for a lot of money several times and walked away from it. I don’t think Kimberley will sue Bolling because she’s a lawyer and thoroughly understands the subject of litigating and my take is she likes Bolling.
Plus Bolling could counter sue her and all kinds of juicy stuff about Bolling could come out and get in the press.
