LOL: Hillary Says She Believes in Evidence and The Rule of Law

Hillary Clinton's new book What Happened, a recap of the 2016 presidential campaign, is out this week. Naturally a whine filled, woa is me promotional tour from the failed candidate is well underway. Matt has been documenting the ongoing situation

During an interview with USA Today's Susan Page, Clinton insisted the Russians fully colluded with the Trump campaign to beat her and laughably argued she believes in the "rule of law" and "evidence." 

"I happen to believe in the rule of law and believe in evidence, so I'm not going to go off and make all kinds of outrageous claims. But if you look at what we've learned since (the election), it's pretty troubling," Clinton said. 

Oh boy, where do we start with this? 

The woman who deliberately and illegally set up a personal, unsecured email server in her home to host, store and transmit top secret classified information believes in the rule of law? The woman who used BleachBit, not a cloth, to wipe her servers of evidence and 40,000 emails believes in...evidence? 

The woman who was given a free pass by FBI Director James Comey, who decided he would exonerate Clinton of any prosecution referral months before agents were done with their criminal investigation into her mishandling of classified information, believes in the rule of law?

The only proper response to Clinton's pious claim is laughter, preferably out loud. 

During the 2016 campaign, the number one word voters associated Clinton with was "liar." This is just another example that they were accurate in their description.

The director of the FBI said she was “extremely careless” with classified information. That is a violation of the law. For that alone she should have gone to jail. She is the antithesis of the rule of law and she and her husband have gotten away with everything from rape to selling critical systems and minerals to our enemies, and many think, murder. No law has been applied to these criminals and I live for the day when they are in prison.

In the hearing, South Carolina Rep. Trey Gowdy questioned Comey on the definition of intent and how Clinton could possibly evade punishment. ..."

Gowdy: Good morning, Director Comey.

Secretary Clinton said she never sent or received any classified information over her private e-mail, was that true?

Comey: Our investigation found that there was classified information sent.

Gowdy: It was not true?

Comey: That’s what I said.

Gowdy: OK. Well, I’m looking for a shorter answer so you and I are not here quite as long. Secretary Clinton said there was nothing marked classified on her e-mails sent or received. Was that true?

Comey: That’s not true. There were a small number of portion markings on I think three of the documents.

Gowdy: Secretary Clinton said “I did not e-mail any classified information to anyone on my e-mail there was no classified material.” That is true?

Comey: There was classified information emailed.

Gowdy: Secretary Clinton used one device, was that true?

Comey: She used multiple devices during the four years of her term as Secretary of State.

Gowdy: Secretary Clinton said all work related emails were returned to the State Department. Was that true?

Comey: No. We found work related email, thousands, that were not returned.

Gowdy: Secretary Clinton said neither she or anyone else deleted work related emails from her personal account.

Comey: That’s a harder one to answer. We found traces of work related emails in — on devices or in space. Whether they were deleted or when a server was changed out something happened to them, there’s no doubt that the work related emails that were removed electronically from the email system.

Gowdy: Secretary Clinton said her lawyers read every one of the emails and were overly inclusive. Did her lawyers read the email content individually?

Comey: No.

Gowdy: Well, in the interest of time and because I have a plane to catch tomorrow afternoon, I’m not going to go through any more of the false statements but I am going to ask you to put on your old hat. Faults exculpatory statements are used for what?

Comey: Well, either for a substantive prosecution or evidence of intent in a criminal prosecution.

Gowdy: Exactly. Intent and consciousness of guilt, right?

Comey: That is right[]

Gowdy: Consciousness of guilt and intent?

In your old job you would prove intent as you referenced by showing the jury evidence of a complex scheme that was designed for the very purpose of concealing the public record and you would be arguing in addition to concealment the destruction that you and i just talked about or certainly the failure to preserve.

You would argue all of that under the heading of content. You would also — intent. You would also be arguing the pervasiveness of the scheme when it started, when it ended and the number of emails whether

They were originally classified or of classified under the heading of intent. You would also, probably, under common scheme or plan, argue the burn bags of daily calendar entries or the missing daily calendar entries as a common scheme or plan to conceal.

Two days ago, Director, you said a reasonable person in her position should have known a private email was no place to send and receive classified information. You’re right. An average person does know not to do that.

This is no average person. This is a former First Lady, a former United States senator, and a former Secretary of State that the president now contends is the most competent, qualified person to be president since Jefferson. He didn’t say that in ‘08 but says it now.

She affirmatively rejected efforts to give her a state.gov account, kept the private emails for almost two years and only turned them over to Congress because we found out she had a private email account.

So you have a rogue email system set up before she took the oath of office, thousands of what we now know to be classified emails, some of which were classified at the time. One of her more frequent email comrades was hacked and you don’t know whether or not she was.

And this scheme took place over a long period of time and resulted in the destruction of public records and yet you say there is insufficient evidence of intent. You say she was extremely careless, but not intentionally so.

You and I both know intent is really difficult to prove. Very rarely do defendants announce ‘On this date I intend to break this criminal code section. Just to put everyone on notice, I am going to break the law on this date.’

It never happens that way. You have to do it with circumstantial evidence or if you’re Congress and you realize how difficult it is prove, specific intent, you will form lathe a statute that allows for gross negligence.

My time is out but this is really important. You mentioned there’s no precedent for criminal prosecution. My fear is there still isn’t. There’s nothing to keep a future Secretary of State or President from this exact same email scheme or their staff.

And my real fear is this, what the chairman touched upon, this double track justice system that is rightly or wrongly perceived in this country. That if you are a private in the Army and email yourself classified information you will be kicked out.

But if you are Hillary Clinton, and you seek a promotion to Commander in Chief, you will not be. So what I hope you can do today is help the average person, the reasonable person you made reference to, the reasonable person understand why she appears to be treated differently than the rest of us would be. With that I would yield back.

The White House FBI files controversy of the Clinton Administration, often referred to as Filegate,[1] arose in June 1996 around improper access in 1993 and 1994 to Federal Bureau of Investigation security-clearance documents. Craig Livingstone, director of the White House’s Office of Personnel Security, improperly requested, and received from the FBI, background reports concerning several hundred individuals without asking permission.

The revelations provoked a strong political and press reaction because many of the files covered White House employees from previous Republican administrations, including top presidential advisors. Under criticism, Livingstone resigned from his position.

Allegations were made that senior White House figures, including First Lady Hillary Rodham Clinton, may have requested and read the files for political purposes, and that the First Lady had authorized the hiring of the underqualified Livingstone.

“Filegate” began on June 5, 1996, when Republican Pennsylvania Congressman William F. Clinger, Jr., chair of the House Committee on Government Reform and Oversight, announced that the committee had found, during their ongoing “Travelgate” investigations, that FBI background reports on Travelgate figure Billy Dale had been delivered to the White House.[2]

The following day, the White House delivered to the committee hundreds of other such files related to White House employees of the Reagan Administration and George H. W. Bush Administration,[2] for which Craig Livingstone, director of the White House’s Office of Personnel Security,[3] had improperly requested and received background reports from the FBI in 1993 and 1994, without asking permission of the subject individuals.[4]

Estimates ranged from 400 to 700 to 900 unauthorized file disclosures.[5][6][7][8] The incident caused an intense burst of criticism because many of the files covered White House employees from previous Republican administrations, including top figures such as James Baker, Brent Scowcroft, and Marlin Fitzwater.[6]

Who hired Livingstone issue?

Livingstone seemed to lack qualifications for even this position; he had worked on a number of Democratic Party campaigns and transitions,[19] including being an advance man for the Clinton-Gore 1992 campaign,[3] and his only prior job in the “security” field was that of a local bar bouncer[5] at a Washington, D.C., night club. Livingstone would continue to maintain on the Internet that he had been qualified for the position, that the First Lady had signed off on hiring him, and that his character had been maligned by the general media.[21])

Clinton opponents stated that Livingstone had the highest level of security clearances in the U.S. government.[22] White House officials could not explain why Livingstone was hired, nor who had hired him.[14]

An FBI document suggested that Livingstone had been given his position because First Lady Hillary Rodham Clinton was a friend of Livingstone’s mother and recommended him. Hillary Clinton stated that while she was once photographed with the mother in a large group, she did not know her.[20]

Hillary Clinton was briefly deposed at the White House by the Independent Counsel regarding this matter on January 14, 1998.[13][23] (That same day, the same Office of the Independent Counsel staff were listening to taped conversations of Linda Tripp and Monica Lewinsky; the Lewinsky scandal was soon to break.[23]) In 1999, Clinton gave a sworn statement that she had nothing to do with Livingstone’s hiring.[8]

Livingstone also stated under oath there was no truth to the supposed hiring relationship.[8] Hillary Clinton would later refer to the whole files matter as a “pseudoscandal”.[20]

It makes absolutely no sense that Putin would want Trump in the White House.

Ideologically, Putin and Clinton are closer than Putin and Trump. It would behoove Putin to have Clinton in the White House, not Trump.

Apparently it has not dawned upon the dense one.
