Turley: Obama's Original Obamacare Order Was Unconstitutional, Also Violated Law Itself
Real Clear Politics ^ | 10/14/17 | Ian Schwartz

Legal eagle Jonathan Turley responds to Democrats that say President Trump's decision to reverse former President's order on Obamacare subsidies was unconstitutional. Turley said Obama's decision to order billions to fund subsidies would be analogous to Trump ordering money to build The Wall.

With the egregious complicity of the alphabet agencies, I have no doubt.

Trump knows what Barry abused and I suggest, at the appropriate time, a sit down with Roberts where all the facts are laid on the table. How can someone who was blackmailed sit on SCOTUS? Give Roberts an honorable option of resigning.

Between retirements and the Grim Reaper, Trump very well could appoint seven justices. I can dream.

Check into Robert’s kids, adopted from a foreign source with questionable documentation. I think that was the blackmail.

Maybe Roberts was shown transcripts or photos he didn’t want public.

This week ( actually back on 1/20/17) Trump needs to put all federal employees on the 0bamacare exchanges with special considerations. Congress, courts, staff, bureaucrats, etc

“My suspicion is Filegate had more far-reaching impact than anyone ever imagined. “

I dunno about that. I remember a lot of people ‘imagined’ just such use of that material. To borrow a democrat term in common usage, Hillary “weaponized” the information that she unlawfully obtained.

The Federal courts had already sided with Congress on the insurance subsidy issue. That's really the problem here, and Roberts actually mentioned it in his opinion upholding Obamacare: Congress has all the power they need to fix the stupid law without going to court over it.

I agree generally with the legal points you're making, but as you noted, a federal court has ruled those subsidies unconstitutional. That only happened precisely because Congress went to court.

The problem is that the hurdles for passing controversial legislation are high - you need to have working majorities in both houses, plus the Presidency. I don't believe an unconstitutional act of a prior Congress and Administration should stand simply because opponents can't amass those majorities. If it is unconstitutional, it is entirely proper to go to court to have it stricken.

I concur. Turley has a conscience, and is not a hypocrite, unlike 99.99% of liberals.

Trump very well could appoint seven justices. I can dream.

He has 40 judges waiting on the Senate(Mitch) and they are going nowhere. The debating rule and pink slips will assure none of them set on the bench unless something earth shattering happens.

Both parties count on the Courts to give them cover for getting things done that the people do not want.

“”For all the things upon which I disagree with Turley, I do respect him. Unlike most libs he seems to have a conscience and calls things the way he sees them.””

I think you’re confusing him with Jeffrey Toobin...Turley can’t be a liberal - he always makes too much sense.
