A Virginia mother has reportedly been charged with a felony after putting a recording device in her daughter’s backpack to catch alleged bullying.
Sarah Sims put a digital recorder into her 9-year-old daughter’s backpack in September in an attempt to obtain proof that she was being bullied at Ocean View Elementary School in Norfolk and to show that no one was helping her daughter, WAVY-TV reported.
“If I’m not getting an answer from you what am I left to do?” Sims said of trying to take action on her own, noting the school didn’t respond to her repeated calls and emails.
Sims’ recorder was found, and her daughter was reportedly moved to another classroom. A month later, Sims was charged with felony use of device to intercept oral communication and misdemeanor contributing to the delinquency of a minor, according to WAVY. With the charge, Sims could face five years in prison.
“I was mortified,” Sims told WAVY. “The next thing I know I’m a felon. Felony charges and a misdemeanor when I’m trying to look out for my kid. What do you do?”
Ocean View Elementary School nor the Norfolk School District were immediately available for comment. Ocean View, however, told WAVY that they couldn’t comment on the pending investigation.
Electronic devices aren’t allowed in classrooms, the school said.

My 7 year old daughter had a similar bullying and inappropriate harassment /assault problem which went unresponded to for months. Then I gave my daughter permission to respond. An aluminum baseball bat at recess was her tool of choice. The suspension was well worth it. Nobody ever bothered her again.
The charges against the mother are de facto proof the school is derelict in the duty to protect her daughter
Re putting cameras in every classroom so parents can monitor online at any time... I wonder if Betsy DeVos has considered something like that. The libs are so in love with a Federal Department of Education, and freak out when there’s discussion about eliminating it. BDV should say, “You get to keep the department, but here’s what’s going to happen. New policy: CCTV for real-time parental monitoring.”

Think about this.. When a woman now says she was sexually harrasssed 40 years ago the must be believed, but when your 9 year old says they are bullied they are ignored.

That’s what I did. Sent a registered letter to the principal and the school board, with signed receipts. I told them that I would not only sue the district but them personally for deliberate negligence and strip them of their indemnity.
That got them moving.

The recorder was found....which means they are frisking students and their kit.
These stories always omit the role of the DA/prosecutor. They can indict a ham sandwich, as it were, but they make political calculations with each case. This one would be disastrous in terms of PR and the discovery phase of a trial so odds are they will plead it down to avoid scrutiny.

Wait. Is this *NOT* a ‘public accommodation’?? What expectation of privacy does one presume in a PUBLIC school? These kids aren’t even old enough to (technically) be have all of their Rights (as the schools can search lockers\etc., o true freedom of expression\speech)
