Virginia mom charged after sending daughter to school with device to record alleged bullying

A Virginia mother has reportedly been charged with a felony after putting a recording device in her daughter’s backpack to catch alleged bullying.

Sarah Sims put a digital recorder into her 9-year-old daughter’s backpack in September in an attempt to obtain proof that she was being bullied at Ocean View Elementary School in Norfolk and to show that no one was helping her daughter, WAVY-TV reported.

“If I’m not getting an answer from you what am I left to do?” Sims said of trying to take action on her own, noting the school didn’t respond to her repeated calls and emails.

Sims’ recorder was found, and her daughter was reportedly moved to another classroom. A month later, Sims was charged with felony use of device to intercept oral communication and misdemeanor contributing to the delinquency of a minor, according to WAVY. With the charge, Sims could face five years in prison.

“I was mortified,” Sims told WAVY. “The next thing I know I’m a felon. Felony charges and a misdemeanor when I’m trying to look out for my kid. What do you do?”

Ocean View Elementary School nor the Norfolk School District were immediately available for comment. Ocean View, however, told WAVY that they couldn’t comment on the pending investigation.

Electronic devices aren’t allowed in classrooms, the school said.

I guarantee you that if the situation involved a mother recording a conservative teacher lauding the benefits of the USA, the Constitution, religious liberty, our freedoms, etc., etc. she would have been venerated as a "courageous" SJW doing what was necessary to fight the evils of blah, blah, blah...

As it is, simply defending your child when the administration turns a deaf ear...lock her up...

You go to the principal first. You go every time the problem arises. If problem persists, you go to the superintendent. A few hours off work is worth it.

Everything should be recorded in the classroom. I think with a good attorney and the right circumstances, at least one juror could be convinced to vote not guilty regardless of what the no electronic devices law says.

I personally think kids who are bullied should wear body cams. Schools are by definition public spaces. Parents should have a right to have their children wear body cams. If its good for police officers its good for teachers. Actually I’d support laws requiring public school teachers to wear cams themselves in classroom.

Be careful for that you ask. This is too Orwellian.

Would you want images of your children in school made public? Who has access to the images? Can they be used against a person years later? Do you think there will be more or less lawsuits as a result of such recordings?
Do you think bullying is only carried out inside the classroom, but not behind the bleachers (so to speak)?

I do not know the details of this woman’s case with her daughter. “Bullying” is another term that is becoming diluted in effect via its politicization. In the article I read elsewhere (I only read the headline here), she made an accusation of bullying, but the “journalist” left out what the reader needs to be informed - specific acts alleged. So we are to believe it is a justifiable grievance with no facts to support? Another high tech, internet case of an accusation made, it must be true?

Note the use of the emergence of the catch-all, nebulous concept “micro-aggression”. Is this really about two school kids who can’t get along and have to learn how to work it out, to live with such people? Is this a helicopter mother who is too involved in her child’s normal development? What does the child’s father think?

If I were the judge, I’d dismiss the charges with a warning (no more taping)/advice to contact the principal of the school to address the situation. The school administration should have just confiscated the device with a warning that next time she could be subject to legal jeopardy. But we don’t know their past dealings with her - is this the 1st time or does she have a history as a troublemaker, crying wolf, etc etc.

While I continued to be very concerned about the state of our education system, the indoctrination, the quality of the teacher and the texts, etc, ....omnipresent technology filming every second of the classroom is not going to solve the alleged problem.

Norfolk has some of the worst daughters and sons of Obama in the whole USA. Actually Portsmouth too. In fact every jurisdiction in Hampton Roads has enclaves that are dangerous no-go zones. I pity any schoolchild who has these FIAs (Future Inmates of America) for schoolmates.

Felony? What they be smokin'? Thaz right, Commonwealth's Attorney is probably a "D" or Son of Obama too.

First charge will get tossed as Virginia is a one party consent state. Only one person in a conversation needs to know of the recording. The second charge is ludicrous and will be easily defeated showing the intent was to prevent/uncover a crime.

Doesn't matter if the charge gets tossed, the school still caused the parents to have to pay $thousands in legal defense fees.

Every teacher’s paycheck is compliments of the kids’ parents. The employer (parents) have the absolute right to know how the employee is performing.

Agree. Zero tolerance ensures the kid being bullied, and who stands up for himself is now suspended. How is that fair?

It is the school who are too lazy to investigate so they just suspend, and punish both parties, and they think the kid being bullied after that is going to have faith in the school!! no way.

I’m going to call the school at the they get back from Thanksgiving vacation and bug them about their lack of effort to stop bullying in their school.

No business would be allowed to have this kind of harassment going on in the workplace as kids that are bullied experience.

Schools have been trying to solve the bully problem for decades. And they only seem to make it worse. Generally, the only people who ever get punished for bullying are the victims and the families of the victims.

They sure came after us. My child was bullied terribly. Complaints about it were met with legal action - against our family. I had the means to fight back. If we were poor, they would have walked all over our family.
