f that’s the case there is a simple solution, heavy fines for selling liquor without a licence. Frequent inspections, sting operations, will drive them out of business.

They're not illegally selling alcohol. Restaurants are allowed to sell liquor. These "delis" consider themselves restaurants for the sole purpose of selling liquor. Except they're not really restaurants. They don't have public restrooms as required and they don't maintain seating. Restaurants also don't have cashiers behind plexiglass barriers. They have waitresses that take your money.

What the city council is saying here is, "If you want to call yourself a restaurant, become a restaurant. If not, go away."

It would help the discussion if you were consistent with your arguments. First they were illegal liquor stores but now they are not selling liquor illegally. Now the problem is they are restaurants that are not really restaurants. I assume that Philly being a liberal city has tons of regulations regarding who can sell alcohol and what constitutes a restaurant. I presume that the Korean owners, being smarter than the nominal Philly politicians have found a loophole in the regulations that allows them to sell booze in their mom and pop convenience stores. I suggest the solution is for Philly to hire a non-affirmative action lawyer to draft legistation to close the loophole, rather than base their objection that the bulletproof glass hurts their constituents feelings.

Although it will affect them, this was not aimed at mom-n-pop type convenience stores. They’re trying to get rid of establishments that are skirting the liquor laws and licenses. Basically they are small shops crammed with tables and chairs allowing people to purchase and drink alcohol on site without a license. They do have a minimal amount of “food” for sale.

You are unaware of the real reason for the use of the bullet proof glass. It is to eleminate and or minimize the bodily injury to the employee whose injury on the job falls under the WORKERS COMPENSATION LAW that every state has.

The WC law calls for UNLIMITED MEDICAL PAYMENTS for on job injury. Emergency room treatment can run as much as $10k per day, if not more.

WC law calls for LIFETIME PMT of weekly benefits if totally disabled from the on job injury.

WC law calls for cost of funeral and burial, payment of benefits to children to age 18 and LIFETIME PMT to the widow, unless she remarries, which they never do. Bird in the hand is worth two in the bush.

The prudent employer buys WC insurance to provide these benefits otherwise the employer is responsible for paying these benefits. With the removal of the bulletproof glass the severity of the claims will incur huge medical bills, compensation for disability and at worst, pmt to kids and widow for years to come. You are easily looking at claim cost per incident of $250k per incident, if not more.

The premium cost for WC insurance is going to increase substantially as these claims come in and have to be paid.
What will also happen is that the availability of coverage from a reluctant insurance market will become more and more limited making coverage available only through the Assigned Risk pool in the state.

The cost of replacing the RACIST protective plexiglass is a drop in the bucket once the WC claims and premiums start to roll in over the next two to three years. Some people are born with a “Terminal case of the Dumb Ass” for which there is no known cure. Unfortunately, they live into adulthood when their existence begins to impact other people.

Does the City not have the power to deny or revoke a business license? That would seem to be the simpler solution.
