It would probably be very difficult to make a case stick against Mueller (otherwise, prosecutors would be sued like this all the time).
Rosenstein, on the other hand, is a whole different story. Since he recused himself from the Russia-Trump idiocy and appointed Mueller to act as the "prosecutor" in the matter, he may have compromised any claim he might have for immunity as an officer of the U.S. Justice Department in the matter.

This country could very easily fall under a Dictatorship by Special Counsel if any President can command the appointment of Special Counsel and then that Special Counsel can prosecute whatever scope of investigation they want to take without any limitations whatsoever. Ripe for Dictatorship by Political Prosecution.

One of the reasons to do this is that Federal civil discovery rules are much, much more broad than in criminal cases. There is very little discovery afforded in Federal criminal cases. It’s a old lawyer trick.

Is there a discovery process? If so, Manafort’s attorney gets partial info during discovery. Then Judicial watch uses that partial info in FOIA requests to get more.

First, I believe that the pool of evidence used by the Mueller team and their conflicts of interest are so overwhelming they can indict anyone they want, but will never get a conviction at a formal trial as almost all evidence will be thrown out.
Of course the Mueller goal is to assemble a pack of lies that get pulled together for an impeachment article, which is a political action and not governed by court rules.
This counter suit if allowed, should allow for some very interesting discovery
