Could it be that Mueller suddenly realized that if he sentences Flynn on a bogus charge, his own sentence may be much more harsh?

Or is it the thought of Flynn fighting back with his new knowledge of why the evidence against him should be suppressed? I bet discovery in that case would be really interesting.
