A coalition that includes a Latino membership organization and a former Massachusetts governor filed lawsuits on Wednesday challenging how four U.S. states allocate their Electoral College votes in presidential elections.
The lawsuits were filed in federal courts in Massachusetts and California, states that went for Democratic nominee Hillary Clinton in 2016, and South Carolina and Texas, where a majority of votes went to Republican U.S. President Donald Trump.
The lawsuits challenge the winner-take-all system used in those states to select electors who cast votes for president and vice president in the Electoral College after a presidential election. Forty-four other states and the District of Columbia also use that system.
Under that system, the candidate who wins the popular vote in a given state gets all its electors. To win the presidency, a candidate must win at least 270 votes from the 538 electors in the Electoral College

The Constitution is quite clear. State legislatures have plenary power to determine how presidential electors are allocated. Period. Full stop.

This is an absurd lawsuit based on the plain language of the Constitution.
My guess would be that they will argue that, because the states have decided to select electors by popular vote, that it’s unfair to do it on a winner take all basis.
This could backfire, if states respond by rescinding popular votes in presidential election, and just let the legislature directly appoint electors.
If some liberal judges agree with the lawsuits, things could get ugly, with unintended consequences.
The US Constitution gives Democrats and other Communists constipation. They want it to become a living, breathing document - so they can kill it.

Nebraska and Maine already allocate their electoral votes proportionally based on the in-state vote.
Other states have the right to do so if they wish.
You can bet that there is little interest in changing the state's "winner take all system" in high population, heavy democrat states like California and New York.
Their interest is in forcing all other states into a system decided by national popular vote so they can dominate elections.
I see an effort to decertify President Trump’s election from a different direction. The Russian Collusion has ran out of steam and the Left is trying to generate another insurance tactic in case it runs totally dry. David Boies and a Latino organization are promoting it. That raises red flags about the hatred for this country involved in this effort.
Even worse, once it happens Republicans have a history of rubber stamping Democrat lawlessness, be it Mr No Repeal Eisenhower or Ted Cruz (whose father was not a citizen when he was born) entering Presidential politics.

The electoral college is the constitutional structure of the republic’s elections.
This is why the founders went to such great lengths to outlaw democracy. It is a failed and destructive form of government.
