Breaking: Supreme Court refuses to hear Trump challenge on DACA

The Supreme Court on Monday delivered a blow to the Trump administration by refusing to hear the government's challenge to a lower court ruling that has temporarily blocked the administration from winding down the Obama-era Deferred Action for Childhood Arrivals (DACA) program.

The Department of Justice’s request was rare in that it asked the Supreme Court to jump ahead of the 9th Circuit Court of Appeals in reviewing the case.

The court typically will only bypass an appellate court when there’s an emergency involving foreign affairs, a serious separation of powers concerns or when it has already agreed to hear another case dealing with the same question.

Trump needs to just not listen to them and fire those judges for exceeding their authority.

Trump cannot fire a Federal judge. Congress would have to impeach them. Read your Constitution.

It was an illegal non-constitutional executive order applying the legal auspices of the federal goverment to an illegal act- protecting the children of illegal aliens.

There is no “ruling” from any Court that Trump has to follow- since there is no “Law” that supported the original action. Simply— Trump will let the “DACA” non-law to dissolve, and supply the manpower, legally to get these people out of the i—which is his Constitutionally described Power— no mistake about it.

Like Andrew Jackson, but with significantly more written Constitutional power- he simply ignores a court’s “opinion”, following the path of the Supreme Court to not entertain the constitutionality of a lower court. GAME, SET, MATCH.
The Jackson reference— the refusal to accept Supreme Court decision to support Cherokee land ownership in Georgia. Quote: John Marshal has made his decision- now let him enforce it” Jackson was a democrat btw. Ordered the Cherokee removed (like that or not, he did it, and for the gold rush in Dahlonega).

Should send the dems right aound the bend.

If DACA had an expiration date, that in and of itself is “notification”. My drivers license has an expiration date. On that date it is no longer valid. Nothing needs to be done to ensure it is no longer in effect.

But I’m operating on the assumption that DACA had an expiration date. Maybe it didn’t.

Yes. And some other Liberal judge will find a way to issue an injunction against it. And SCOTUS will again refuse to take the case. And we'll still be stuck in this feedback loop.

I find the Christian author Larry Burkett’s fiction book “The Illuminati: A Secret Society Revealed” very interesting where one of the first events is the president having all of the Supreme Court Justices that vote against him assassinated.

A lot of people are under the impression that DACA was issued as an executive order. It was not. Obama had Janet Napolitano issue a policy memorandum to Homeland Security. Here's the Federal Register. You will not find DACA in it because it is not an executive order in any shape or form.

Well I have no argument with your assertion that the courts are assuming power they do not really have, and have been doing so for decades before Donald Trump became the President. And yes, he could have rescinded the DACA law, and in essence he did. However, he followed the Constitution in that he gave Congress the opportunity to determine the fate of DACA, as immigration policies are part of their Constitutionally defined duties, but he also gave them a deadline, as DACA was never enacted or passed by Congress, but rather the edict of an EO that itself was illegal and not Constitutional.

I do not feel he punted the ball at all, it was a powerful bargaining chip to get what he wanted, money to build the wall. Like he, I feel the wall is a much more important factor for the security of this country then the status of some 800,000 who have signed up for DACA. Would I prefer that he remove all illegal aliens, absolutely, but then again you can't always get everything you want, but go for the important pieces. Remember he is also trying to remove chain migration and the stupid immigration lottery system as well, not just the wall.

As soon as the appeals courts hear the case, and of course rejects his arguments, then the Supreme Court will take the case. Would you rather he acted like a dictator? That would certainly get him impeached. Remember he is fighting forces from the opposition but also forces within his own party.

You state that the Constitution is dead, so I guess that means you think that President Trump should act accordingly. I for one do not see it as dead, but is and has been severely under attack, just as the 2nd Amendment has. The way to fight that attack is not to ignore the Constitution, but rather to use it and not give Congress, the ammunition for impeaching him. If you expected his campaign promises to be enacted easily, you obviously underestimated the evil that occupies high positions within our government. That evil is not just limited to those holding high positions either.

Sessions, the guy who Trump appointed and promptly surrendered control of the DOJ back to the communists again.

Trump is scared to get rid of him, fears impeachment.

I want to say the tyranny of the judiciary is the elephant in the room nobody talks about but then I remember the Federal Reserve and numerous other elephants so it’s only one among many, sadly.
