The University of Cincinnati suspended a female student for allegedly engaging in nonconsensual sex with a male student who claimed he was too drunk at the time to approve the encounter.
The fact that this case involves a male accuser ("John Doe") and a female aggressor ("Jane Roe") makes it unusual among Title IX complaints. (Title IX is the federal statute that forbids sex discrimination in schools.) But the female student's lawsuit against Cincinnatiwhich accuses the university of violating her due process rightsreveals something even odder: Roe had previously filed a sexual misconduct complaint against one of Doe's friends.
Roe's lawsuit, then, suggests that Doe filed the complaint against Roe as a kind of revenge for getting his friend in trouble. (I have an alternative theory, but I'll save that for the end.)

The use of DOE Title IX “guidance” issued by the Obama administration, on matters of sexual misconduct, needs to cease and desist.
Colleges need to quit adjudicating any of these matters themselves. We have laws regarding sexual assault and rape in every state, and civil courts in every state can adjudicate civil complaints between parties, for whatever reason. All these matters need to be turned over, as necessary, to local police, prosecutors and courts, and handled by them, not the colleges. The only actions colleges should be able to take in such matters need to come, if needed, after completion of the processes with local police, prosecutors and courts have made a LEGAL determination.
Colleges need to quit acting like sovereign entities unto themselves, conducting kangaroo courts and kangaroo judgements without either party obtaining the rights or the obligations that would exist with the police, prosecutors and the courts.
Until such legal proceedings happen the most one party might be able to obtain is a court approved order to keep their distance from each other, as much as possible, but until then the school should not be causing any academic impairment of anyone. And should such an injunction be obtained falsely, the law should be clear that the false accuser is liable for any damages incurred by the accused.

What’s this male/female stuff? I thought there was no binary, and that there is an infinite spectrum of genders. That you can “identify” as one or the other or any one of the others, and that you can change your identity as often as you want.

Indeed, if you suspect you are going to become the subject of a Title IX investigation, the optimal strategy may very well be to file the first complaint. For reasons not completely clear to me, Title IX administrators often appear biased in favor of the initial complainant, and presume the other party is the wrongdoer.
