Judge denies motion to detain New Mexico compound suspects after hours-long hearing

ALBUQUERQUE, N.M. – State prosecutors' motion to detain five adults arrested after a raid in northern New Mexico earlier this month was denied by a judge on Monday.

Judge Sarah Backus made the determination the suspects weren't a danger to the community following several hours of testimony and evidence being presented by prosecutors. Siraj Wahhaj, Hujrah Wahhaj, Lucas Morton, Jany Leveille and Subhannah Wahhaj each face 11 counts of child abuse, after 11 children were found living in deplorable conditions at the site.

Each suspect will have a $20,000 bond and will have to wear ankle monitors. In addition, they will not be allowed to leave the country, and any visits with children will be supervised.

State prosecutors outlined evidence suggesting that at least some of the suspects could have been planning some sort of attack. They said Siraj Wahhaj – who also faces child abduction charges from Georgia after allegedly taking his 3-year-old son – took several weapons classes before coming to New Mexico, and books found on the compound focused on how to build firearms at home.

Various weapons and ammo were found during the raid on August 3, and several more firearms were discovered in subsequent searches. The children were allegedly taught how to load and fire assault rifles.

Agreed...totally nuts...not a danger...moron for a judge...in a way she is just as dangerous to the public as they are..but I wouldnt be surprised if she was threatened by the local CAIR unit.

They make this sound like a bad thing, on par with kidnapping the three year old and training them to shoot up schools.

Didn’t they find the dead body of a child in the compound? I would think that would be enough to hold the adults until trial.

Not being sexist at all......just some women shouldn’t be out of the house much less on the bench!! Now, THAT’S sexist in some peoples minds but I don’t care and I stand by what I said.........;)

I suspect the problem is “wearing big boy pants”. Women simply don’t fill up the gear locker. Anyway, as I was taught years ago, “men wear trousers, women wear pants”.

Looks like just your typical bleach blond, post-menopausal liberal looking to square things in the world for all those poor, innocent oppressed?

Take a good look at the eyes of the accused at this web site showing a cropped three minutes of the bail hearing. The state prosecutor looking and acting like a putz and making statements contrary to the news reports I have read: i.e. "...they were buying the land.."

ALBUQUERQUE – District Court Judge Sarah Backus, an elected Democrat, has released the suspects from the Taos County terrorist compound until their trial begins. According to media reports, suspects will be released on a signature bond, and will not have to post bail prior to their release.

“Judge Backus has put New Mexicans at risk by releasing suspected terrorists back into the community,” said RPNM Chairman Ryan Cangiolosi. “By releasing these suspects without even requiring them to post bail, Judge Backus has put people in danger and created the risk that they could flee and harm other children and communities as well. If New Mexico Democratic Party leaders are serious about keeping our state safe, they should join me in denouncing Judge Backus and the incredible failure of leadership and judgment demonstrated by her terrible decision.”

The suspects have been accused of training children to commit acts of terrorism, including school shootings. They were also charged with several counts of child abuse. According to a KOB report, Judge Backus determined the accused terrorists pose no threat to the community:

People who are suspected of killing children and orchestrating mass shootings should not be allowed to walk out of the courthouse and back into their communities with almost zero guarantee that they will ever show up to trial. Regardless of political party, New Mexicans can recognize the danger of the judge's ruling and the risk it poses to public safety. This is Exhibit A as to why we need to pass a new constitutional amendment that would require judges to keep dangerous criminals like these in jail pending trial.”

The children discovered at an “extremist Muslim” compound in New Mexico earlier this month were both trained to use firearms and taught multiple tactical techniques in order to kill teachers, law enforcement and other institutions they found corrupt, state prosecutors revealed on Monday.

The prosecutors provided more details about the accusations during a court hearing in which they asked that Siraj Ibn Wahhaj and four other defendants be held pending trial on child abuse charges.

But the judge in the case ruled against prosecutors’ request.

Judge Sarah Backus said although she was concerned by "troubling facts," prosecutors failed to articulate any specific threats to the community.

She set a $20,000 bond for each defendant and ordered that they wear ankle monitors and have weekly contact with their attorneys.

It was also announced Monday that 3-year-old Abdul-ghani Wahhaj, who had been missing since December, allegedly died amid a ritualistic religious ceremony intended to “cast out demonic spirits,” Reuters reported.

“It was a religious ritual carried out... a ritual intended to cast out demonic spirits from Abdul-ghani Wahhaj,” Taos County Prosecutor John Lovelace said.

Public defenders argued the boy's father was trying to heal the child by reading passages from the Quran but prosecutors claimed he was denying the boy medication. One of the children taken into custody claimed that the boy had died in February.

The children said they were told the boy would be resurrected as Jesus and guide them on which "corrupt institutions" to attack, NBC reported citing investigators.

It wasn’t immediately clear if the remains of a child found on the grounds of the compound were Abdul-ghani Wahhaj.

The defendants were arrested and 11 children were taken into custody during a raid Aug. 4 on the compound near the Colorado state line.

Wahhaj and the others were seated with their public defenders in a Taos courtroom Monday as prosecutors presented books that were found at the compound, documents related to Wahhaj's trip to Saudi Arabia and a handwritten notebook that appeared to be some kind of teaching manual. They also pointed to evidence that Wahhaj had taken a series of firearms courses while in Georgia.

Defense attorneys, meantime, argued that prosecutors were trying unjustly to paint their clients as armed militants. Public defenders also argued that the rifles and handguns found on the property were common guns that could be bought at retail stores and that their clients made no aggressive efforts to defend their compound.

Wahhaj is the son of a Brooklyn imam, also named Siraj Wahhaj, who was named by prosecutors as an unindicted co-conspirator in the 1993 World Trade Center bombing, the New York Post reported. The elder Wahhaj, who heads Masjid At-Taqwa mosque, was a character witness in the trial for Sheik Omar Abdel Rahman, the notorious “blind sheikh” who was convicted in 1995 of plotting terror attacks in the U.S.
