Levin: Paul Ryan was dead wrong on birthright citizenship. Here’s how

Tuesday on the radio, LevinTV host Mark Levin ripped Speaker of the House Paul Ryan, R-Wisc., for his response to President Trumps statement that he plans to issue an executive order to end birthright citizenship.
Ryan claimed the 14th Amendment creates the birthright citizenship and that therefore such an executive order would be unconstitutional.
Theres been no law passed that conveys birthright citizenship onto illegal aliens. Theres been no Supreme Court decision that definitively confers birthright citizenship onto illegal alien children. Nobodys a hundred percent certain how this came to be. But everybody seems to be a hundred percent certain that the president cant fix it.
Well, does the Constitution confer birthright citizenship on the children of illegal aliens? Of course it doesnt!
Levin replayed a clip from his show in 2015, in which he laid out the stated purpose of the 14th Amendment and read Senator Jacob Howards explanation.
This will not of course include persons born in the United States who are foreigners, aliens
but will include every other class of persons. It settles the great question of citizenship.
Is it not plain English? Is he not as clear as can be that it does not include aliens, it does not include foreigners.
The republican basis for citizenship is consent! Consent of the country! You cant self-immigrate. You cant claim jurisdiction because you happen to walk into the United States.
What is the bottom line here? Lets number this: They wanted to make certain that former slaves would be treated as citizens of the United States, because certain states were still resistant.
They exempted Indians, because Indians still, certainly back then, were often considered citizens of particular tribes. But these actually were very forward-looking individuals. They specifically excluded aliens and foreigners.

the 14th amendment definitely does NOT create “birthright citizenship!!!!!” Absolutely not, indeed the authors of the 14th wrote it extremely carefully to specifically prevent it from doing that!
Mr. Ryan, please review your Constitutional Law class notes

I’m a naturalized American citizen and a veteran...I know what it takes to immigrate and to become an American citizen...
I also know the love of country involved to serve in our military...
none of these attributes are in the hearts and minds of illegal aliens ...they don’t came here to serve our country but to demand and take benefits which should go to disabled veterans and other American citizens...
“subject to the jurisdiction thereof’ also means to me to be willing to respect and obey our country’s immigration laws...illegal aliens come here with no intention to do so...in fact its a cute game they play to see just how much they can get away with...
BTW they video of the aggressive hordes in the so called caravan reminds me of watching the TV in Sept 2015 of the Moslems marching through Europe...same young military aged men same destruction and attacks on local LE and immigration officials at the borders...

When he omits the part of the quote that guts his argument - "...who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States..." you know he has nothing but bluster.

What are the rules for people born between December 23, 1952 and November 13, 1986? The 14th Amendment IS a part of the U.S. Constitution and states in SECTION 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.
So, under that power to legislate, Congress legislated antd the President signed into law: When ONE parent was a US citizen and the other a foreign national,the US citizen parent must have resided in the US for a total of 10 years prior to the birth of the child,with five of the years after the age of 14.
... While there were initially rules regarding what the child must do to retain citizenship,amendments since 1952 HAVE ELIMINATED THESE REQUIREMENTS.
When Ted Cruz was born, his parents were "IN WEDLOCK".
They married, moved to Calgary, Alberta, and in late 1970 had their first and only child, Rafael Edward Cruz.
Cruz was born on December 22, 1970 in Calgary, Alberta, Canada where his parents, Eleanor Elizabeth Darragh Wilson and Rafael Bienvenido Cruz.
Cruz's mother was born and raised in Wilmington, Delaware, in a family of three quarters Irish and one quarter Italian descent.
Eleanor Darragh, mother of Ted Cruz, was raised in Delaware, graduated from a Catholic High School (1952) in the U.S., as well as Rice University (1956),so clearly she meets the residency requirements.

So there is the law for the time Ted Cruz was born,
AND HOW Ted Cruz's PARENTS fulfilled ALL those requirements of the law that time,
for Ted Cruz to be a "Natural Born Citizen".
Ted Cruz did NOT NEED a Court and a Judge to "Nationalize" him.
Senator Cruz became a U.S. citizen at birth, and he never had to go through a naturalization process after birth to become a U.S. citizen, said spokeswoman Catherine Frazier.
... The U.S. Constitution allows only a natural born American citizen to serve as president.
Most legal scholars who have studied the question agree that includes an American born overseas to an American parent, such as Cruz.
