Migrants sue Trump, govt; claim violation of constitutional rights (Nexus Services Inc. funds)

A dozen migrants from Honduras filed a class-action lawsuit Thursday against Pres Trump, DHS, and others, claiming a violation of their due process under the Fifth Amendment.....that "no person… shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law." A recent PBS report cited former Supreme Court Justice Antonin Scalia, who ruled in 1993 case that "it is well established that the Fifth Amendment entitles aliens to due process of law in a deportation proceeding."

Twelve Honduran nationals, including six children, are listed as plaintiffs in the lawsuit filed Thursday in the US District Court in Washington, D.C., said it is widely known that Guatemala, Honduras and El Salvador are “undergoing a well-documented human rights crisis.” The lawsuit also claims that the plaintiffs’ right to the Administrative Procedures Act and the Declaratory Judgement Act were being infringed upon.

The Central American migrant caravan now numbers approximately 4,000 people, down from a high of 7,200. The lawsuit points to Trump's claim that he will prevent the caravan from entering the U.S. It claims that the president cannot stop asylum-seekers by employing the military -- when they have a fair claim. The suit criticized the president's attempt at stoking "fear and hysteria," by claiming that criminals and gang members have joined the caravan. The suit cited a Trump interview with Fox News’ Laura Ingraham, where the president laid out plans to build tent cities to house migrants. The suit questioned the functionality of such a project, and asked if these living quarters would qualify under the Flores Agreement of 1997.

They have NO Constitutional rights, period.

The get nothing other than what we decide they will.

We DO have the right to detain them in any manner we see fit and to take action against them for their illegal entry to U.S. soil.

Here’s the US law.
8 U.S. Code § 1158(a)(2)(A) says that if a foreigner can reach a safe country after leaving their own country where they have a credible fear of persecution, then they cannot qualify for asylum in the United States unless the govt determines it to be in the interests of the U.S.A. to grant them asylum

My word!!! If this lawsuit is allowed to proceed, and some crazy judge will allow it to, what is the limit? What is to stop some foreign government to sue to stop U.S. military action against it, or tariffs, or sanctions? All they would have to do is have their citizens sue for a violation of their constitutional rights.

The irony here is that to left, the migrants have more rights than us deplorables or even a guy like, say, Brett Kavanaugh.

Agree. Put the military at the border and keep them there until the wall is finished. Order them to defend the border by any means necessary including firing upon anything that moves.

Stop all immigration until every last illegal and visa overstay is deported. Forget fines, jail every employer and close down their business. Jail landlords and, similar to drug dealers’ vehicles, put the houses up for public auction. No more tolerance to anyone aiding and abetting them and that includes priests and other do gooders. No more illegal kids in school. No more government freebies. Once every last one is gone, then we can talk about LEGAL immigration again.

Sure, all that sounds harsh but not nearly as harsh as making real taxpaying US citizens pay for them and have our children exposed to whatever disease they bring here. There was a thread a few hours ago on the caravan with one guy having a severe cough. Excuse me, don’t bring that here.

Another idiot lawyer who needs his ticket revoked.

International law says they have to request asylum at the first safe country they arrive at.

Mexico offered them housing, jobs, medical care & they said NO.
