Yes, although Republican control does not guarantee an easy confirmation, particularly if the appointee’s purpose is obstruction of justice as this one’s clearly is.

I believe he'd have to be nominated by the President first.

This is a temporary appointment for 210 days as you said....with the possibility of an additional 210 days.

Ordinarily, the position would have gone to Rosenstein. The Dumb a** should have never even thought about wearing a wire...no less expressing the same at a meeting.

Let's just say....the President thought long and hard about this and the Dems are really, really p*****.

It’s a quirk in the Vacancies Act. If an Acting AG is nominated, someone else becomes Acting AG until the nomination is approved.

I believe the idea was to emphasize the Senate’s role, like the time limits do.

If the Acting AG is nominated, someone else becomes Acting AG while the nomination is considered. That does seem a little confusing, but that is how it works.

Here is what I would do if I were Trump.

Let Whittaker continue until the Senate session ends.
When they FINALLY go out of session, recess appoint someone the establishment will REALLY hate (Joe DeGenova, Jay Sekulow, etc) as AG. Then when the Senate reconvenes formally nominate Whittaker, who whomever else he wants.

The Senate will have their rock-and-a-hard place choice. Either confirm my nominee, or continue to live with that guy you really hate.

To me, what you’ve explained makes more sense than to say, in effect, that an Acting AG cannot be elevated to AG. Once he’s nominated he is deactivated and another acting takes his place while the former acting is being confirmed. Got it.

Yep. You got it. The Senate does get to assert that a temp agency head is actually a temp and not just a way to circumvent confirmation.

This looks like the applicable section from the Act

“(b)(1) Notwithstanding subsection (a)(1), a person may not serve as an acting officer for an office under this section, if

“(A) during the 365-day period preceding the date of the death, resignation, or beginning of inability to serve, such person

“(i) did not serve in the position of first assistant to the office of such officer; or
“(ii) served in the position of first assistant to the office of such officer for less than 90 days; and

“(B) the President submits a nomination of such person to the Senate for appointment to such office.

The only obstruction of justice that’s been occurring has been on the part of Mueller by investigating Trump for collusion when it’s obvious the collusion was by Clinton, Obama, and everyone associated with them. Appointing an AG who will actually act as an AG is not obstruction. Kindly remove your head from your fourth point of contact.
