The cable network made an emergency request so its correspondent could have access to the White House as lawsuit continues.
WASHINGTONA federal judge granted an emergency motion to restore the White House press credential of CNN correspondent Jim Acostaa victory for the network in a closely watched press-freedom case.
The lawsuit could determine whether the government can ban individual reporters from public buildings.
District Judge Timothy Kelly, who was appointed to the bench by President Trump, granted CNNs request for a restraining order temporarily restoring Mr. Acostas press access to the White House while the case proceeds.
Lawyers for Mr. Acosta, the networks chief White House correspondent, argued that the unusual revocation of a reporters press pass by the White House last week necessitated emergency action.
Mr. Trump has regularly attacked CNN, and Thursdays ruling was a setback for the White House. Government lawyers acknowledged in court they knew of no other situation where the White House had revoked a press pass under similar circumstances.
The legal maneuvering was part of a CNN lawsuit alleging that the Trump administration violated Mr. Acostas First Amendment right to gather news, as well as his due-process right to challenge a government-imposed punishment. Judge Kelly didnt rule on the merits of CNNs overall case.

Agree. You can be there and yuk it up with your friends, but that doesn’t mean you must be called upon. You can sue to establish that and take this to the next level... Hopefully The Donald has game planned it this way.
OK, build a “crying room” for Acosta - and lock him inside with an armed guard during WH press briefings.
He would spend the entire press conference screaming from the back of the room.
The ONLY solution is to stop holding press conferences
First answer is to end breifings. Barring that put Acosta at the very back row and ignore him.

Judge Kelly is referencing a previous case, which he says did set a precedent where a journalists fifth amendment right to due process would apply to a case like this.
Kelly agreed with the White House that there is no First Amendment right to be on the White House grounds, but added that Acosta did not receive due process before his pass was revoked.
Judge agrees with the White House that there is no first amendment right to come onto the White House grounds. HOWEVER once they do open up WH grounds to reporters but denies others, first amendment comes into play.
Judge Kelly further explained that Trump is not required to call on Acosta at press events but that Acostas First Amendment rights are more important than the White House being able to have orderly press conferences.
Judge Kelly says Trump need not ever call on Jim Acosta again, but Acosta is owed due process if his hard pass is going to be revoked.
Kelly says plaintiffs have shown likelihood fifth amendment rights were violated, and there is irreparable harm.
The case, however, is not over. Judge Kelly provided temporary relief to CNN, but there will be additional hearings before an official ruling is handed down on whether the White House violated CNNs First and Fifth Amendment rights.

But, if press briefings at the White House are cancelled, how will the Trump Administration be able to get out the good news of all the wonderful work it has done for the American people?

No-one has a “right” to a press pass.

According to the ruling, since we are all “news gatherers” we should all be entitled to get press passes.
But this is not really about freedom of the press. Its more about the UNACCEPTABLE BEHAVIOR of one Mr. Acosta. He acted in a disrespectful and disruptive manner.
Virtually anyone who acts in a manner that is outside of the expected bounds of decorum will get removed from any event anywhere. No individual should be permitted to disrupt the proceedings being attended by others.
What he did was not gathering news, it was deliberatively interfering with an event that should be news.
Who else gets a press pass now? Alex Jones? Some guy from Al Jazeera who can’t pass a background check?

This is about as ridiculous a ruling as I have ever seen by any court. There is an easy fix however to keep the problem from being a problem. Each time they hold a press meeting and Jim Acosta shows up they need to announce that since Acosta is there they are not going to have the event. Acosta will go back to court perhaps, great, let him meanwhile all the other reporters know that because of his asinine activity they do not have access.
The president or his staff should announce that all press interaction will be discontinued until after the court case is complete if Acosta shows up.
I hope there is no one on this forum who would ever consider watching CNN. I have to fly this weekend and I will be in several airports and I will complain to someone every time that I see CNN on a TV in any airport.

I had an article published last week - do I get a press pass? If POTUS issues a press pass to all conservative journalists and assigns seats to each one, Acosta could sit in the back.
Why even continue the briefings?
Because Sanders is awesome at it. Keep getting out Trumps side while denying the CNN/NPRs their opportunity to make themselves the news.
Every right winger blogger in America should be given a press pass and Trump should only take questions from them.

they can do that but to me it doesn’t mean he has to be called on. Let them all walk out in protest and invite some replacements like Project Veritas to comment and see if the MSM will even touch what they present....
