If this goes on into February, someone should seek some sort of proof of life. This wouldnt be the first time that clerks and assistants reviewed cases and wrote opinions on behalf of a Supreme Court Justice. Look for her at the State of the Union speech by Trump.
Will RBG be able to attend?
If not, it will not “disqualify her” from the Court - Old people, after all, do get sick. Not showing up is not evidence she is on a “permanent” respirator/feeding tube/drain tube.
But, if she is there but clearly not able to stand up, to walk to her seat before the speech, to stay awake through a simple speech in front of the public and the world, then DOES that not disqualify her from remaining on the Court?
Now, notice that Pelosi and Schumer do not want Trump to make a public State of the Union speech! Is that not also an indication Ginsberg is not physically able to attend?

There is nothing, specifically enumerated, short of impeachment for crimes/misdemeanors, that "disqualifies" or automatically compels her retirement besides death. I am not familiar with precedence suggesting that a justice can be removed because of mental incapacity issues. We have certainly had some documented crazies serving as SC Justices in our history. I just don't know if there is precedence for a dead person serving as SC Justice. RBG may be the first.

First order of business should be to do away with Life Terms for Supreme Court Justices. Some continue being cognizant well into old age, but some do not. Give younger people the opportunity to be on the Supreme Court with more modern ideas. Everyone should forego politics once they reach a designated age, or show signs of poor judgment. Same goes for Senators and Congressman. Wheeling members of Congress in to vote from their hospital gurneys is ludicrous.

That crap is just silly. McVain was not executed and not "put to death." Kaysuck mumbled and misspoke, that's all. McVain had late Stage IV brain cancer and lasted close to the maximum duration for most such cases of glioblastoma.
