Police Owe Nothing To Man Whose Home They Blew Up, Appeals Court Says

An armed shoplifting suspect in Colorado barricaded himself in a stranger's suburban Denver home in June 2015. In an attempt to force the suspect out, law enforcement blew up walls with explosives, fired tear gas and drove a military-style armored vehicle through the property's doors.

After an hours-long siege, the home was left with shredded walls and blown-out windows. In some parts of the interior, the wood framing was exposed amid a mountain of debris.

A federal appeals court in Denver ruled this week that the homeowner, who had no connection to the suspect, isn't entitled to be compensated, because the police were acting to preserve the safety of the public.

So, the cops were absolutely certain the residents weren’t there & being held hostage?

So, going full Waco was protocol?

Really?

Huh.

What if they’d “accidentally” murdered the homeowner in addition to destroying his house?

Do the cops still get to say, oops, we went too far, too bad?

No. Just no. Not under our BOR they don’t.

Yeah I’m sure you’ll continue agree with the ruling when the same happens to your house.

Fact is, the cops had other options to get the bad guy out without reducing the home to rubble.

For instance, a hostage negotiator, even if there are no hostages, can use various psychological tricks to persuade him to walk out.

Sleep deprivation, denial of food, tell him his mama had a heart attack, etc.
Or get him next to a window & sniper takes him down— a broken window instead of a demolished house.

What is your problem

My problem is that I'm sick and tired of watching my country turn into an even bigger police state than it already is, with active support of "conservatives" who should know better.

He demolished the house instead of repairing and built a $900,000 luxury home and hoped the good folks would help him out!

The suit didn’t specify the damages since he had no damages.

It was a shot in the dark Suing for ‘taking’ and asking tonbe awarded whatever the judge deemed appropriate.

And it’s funny, OTGER SWAT TEAMS CAN GET VIOLENT BSDGUYS WITHOUT DOING $400,000 IN DAMAGE OR DRIVING THROUGH THE FRONT DOOR.

Your SF Quake analogy is a bit off, in that just about all homes were damaged in the quake, these particualr homes and buildings were dynamited to create a fire break to prevent the raging fire from consuming the city whole. “Ham and Eggs” fire I think it was called. Started in a damaged home on Van Ness. But then again, things were a little different back then.

Not your everyday house destruction either.

Like I said, it seems the cops could have waited this guy out and arrested him or disabled or killed him when he came out.

Instead, their efforts were overkill in destroying that man's house.

I don't think we have seen the end of this injustice.

Or maybe the police should ask to be transferred to LA, Seattle, or Chicago to use their police state military equipment - it won’t damage as much there! May be in fact be welcomed by the locals!
