Impeachment Opening remarks: Jay Sekulow Demolishes Schiff, Pelosi on Executive Privilege: Remember Eric Holder?

During his opening remarks in the Senate impeachment trial, President Donald Trump's lawyer Jay Sekulow quoted Democrats' own words against them. He condemned the House Democrats' rush to impeach Trump, adding an article of impeachment for "Obstruction of Congress" rather than litigating a matter of executive privilege in court. He quoted House Speaker Nancy Pelosi (D-Calif.), Rep. Adam Schiff (D-Calif.), and Rep. Jerrold Nadler (D-N.Y.), each of whom defended Barack Obama's Attorney General Eric Holder when he was held in contempt of Congress in 2012.

"Mr. Schiff did say the courts don't really have a role in this. Executive privilege? Why would that matter? It matters because it's based in the Constitution of the United States," Sekulow said. "The president's opponents in their rush to impeach have refused to wait for judicial review."

He quoted law professor Jonathan Turley, who warned, "I can't emphasize this enough...if you impeach a president — if you make a high crime and misdemeanor of going to the courts, it is an abuse of power. It's your abuse of power. You're doing precisely what you're criticizing the president for doing."

"On June 28, 2012, Eric Holder became the first attorney general to be held in both civil and criminal contempt. Why? Because President Obama asserted executive privilege," Sekulow noted.

Citing a 2012 op-ed Schiff wrote in Politico, Trump's lawyer said, "With respect to the Holder contempt proceedings, Mr. [impeachment] Manager Schiff wrote, 'the White House assertion [of privilege] is backed by decades of precedent that has recognized the need for the president and his senior advisors to receive candid advice and information from their top aides."

"Indeed that's correct, not because manager Schiff said it, but because the Constitution requires it," Sekulow added.

To Summarize Sekulow's argument, it boils down to this ( he is arguing against one of the charges -- Obstruction of Congress ):

Democrats defended Obama's executive privilege, but they're impeaching Trump when he exercises his.

The first rule of rhetoric is:

REMEMBER YOUR AUDIENCE!

The audience is the American people.

Talk to them.

The Democrat Senators are not going to change their minds.

Talk to the American people.

We are not lawyers or judges.

If Democrats do something, it’s good.

If Republicans do the same thing, it’s bad.

That’s what passes for logic and reason these days.

Something to think about. Lawyers thrive on “Whataboutism”. It’s literally the heart of their philosophy.

Good advice.

But Sekulow's comments may very well be directed, not so much at the Democrats, you are right with your comment, but rather at the 4-5 rinos that may jump ship.

Doesn’t take much to destroy Schiff, Schiff is an absolute IDIOT..he thinks he’s brilliant but he’s a moron. He keeps saying “The evidence against President Trump is overwhelming” well if that is the case than why do we need additional witnesses, call the vote right now..and if the commie media were at least objective they would say that

The only evidence that is overwhelming is that of the Democrats treason!

Yet again, it is shown that the Democrats are blubbering hypocrites. You see what they are truly thinking when they flip flop like this. Their beliefs blow and shift with the political wind and they don’t care about truth. They only care about lying to win; win in their own minds. And the truth and precedents be damned.

Oh, and they will whine like babies when the same precedents that they established are applied to them. Yes, they are hypocrites. But they are only hypocrites if the Republicans allow them to be... so it is party the Republican party’s fault too.

Trump yet again shows the American people the true nature of the Democrats.

Schiff thinks that court cases should be decided with only the prosecution having a turn, and the defendant not having any lawyer to represent him.

If these people ever regain power, I have no doubt they will treat all of us this way.

They are the tyrants.

This whole impeachment is baloney.

Are we going to let every criminal put the prosecutor and police on trial?

This impeachment is Democrat criminals using our tax dollars to try to delay and deny the rightful investigation and prosecution of their criminal actions.

One correction... Eric Holder wasn’t held in contempt for executive privilege. He pled the Fifth to not incriminate himself while testifying... ABOUT HIS JOB!

The “obstruction of Justice” charge is totally bogus and should NEVER have been approved ... Pres. Trump was merely asserting his Constitutional rights

But the Democrats wanted to make sure there was more than one impeachment charge, because then they could suggest there was a “pattern” of wrong behavior

There’s no pattern and no wrong behavior here, just a malicious prosecution by out-of-control Democrats

The official charge is not even “obstruction of justice”. It was “Obstruction of Congress”

Is that lead singer John Elefante of the band — Kansas (of DUST IN THE WIND fame )?
