The attempted "citizen's arrest", regardless of the guys criminal record, was inexcusable. He was running, and therefore was clearly not carrying an item he had just stolen. In no conceivable universe was there probable cause or even reasonable suspicion to attempt to stop him. Certainly, ordinary citizens who are not in any kind of uniform, and are carrying guns, shouldn't attempt to do that.

Just flip the scenario -- you're a white guy out on a run, and a couple of armed black guys -- NOT COPS - try to get you to stop. You're either going to run like hell, or if you don't think that'll work, try to rush one of them and get the gun so you don't get shot in the back.

"Citizen's arrests" should be limited to immediate actions where the citizen actually witnesses the crime, and accosts a criminal they saw committed that crime. Not playing wannabe cop.

Excellent, thorough presentation of the incident.

It’s just another Trayvon and “gentle giant” case, and the race pimps and their anti white media accomplices will milk it for all it’s worth.

How much more suffering do we have to go through to finally realize that this dysfunctional black white “marriage” ain’t working.

Burglar, jogger, whatever. Deadly force by citizens was not the answer here.

Should have detained him for the police to deal with. If he was indeed an innocent jogger, no harm done except for the lawsuit that followed; if proven a burglar "casing" targets, some jail time.

Back in the day, when I trained for marathons, I'd sometimes do 12-15 mile interval training sessions. That consists of repetitions of running hard for a specific distance or time period, then slowing to an easy pace, sometimes even walking it off. I would sometimes get suspicious looks from residents, when I was in the slow mode.

There was no need to wrestle for control of the scatter-gun.

Play stupid games, win stupid prizes.

There was no legal justification to level the shotgun at the perp in the first place, citizen’s arrest or not.

The father-son vigilante team were the ones playing stupid games, and a petty thief lost his life over their actions.

They deserve at least manslaughter convictions.

And by the way, I have jogged/run in hiking boots many times. Not that it matters. The only thing that matters is what happened during the parts of the video when you can’t see the participants.

The shooter is an idiot and will probably pay with a 2nd degree murder conviction.

Exactly. It is the taking of things into our own hands that brings us to ruin. Except in matters of self defense, only a fool would risk it.

Agreed. Does anyone know, did the father-son team even call 911?

I didn’t watch video...only the brief one on the news. Was he deliberately shot or was he trying to wrest the shotgun away from the guy and it went off? I personally wouldn’t want to be pulling on the barrel of a shotgun with a finger on the trigger at the other end.

Verdict first.

Then the trial.

“an excellent review of the actual facts of the case. This is nothing more than attempt by the media/dem complex to whip up their base for the election.”

True.

And all the “artery was a burglar” people are playing right in to the media/dem hands”.

The more it’s talked about “controversially” the better for them.

Burglar, jogger, whatever. Deadly force by citizens was not the answer here.

In one of my CHL classes in Texas, the instructor (a former cop) mentioned the case of a guy here who saw some bad hombres robbing his neighbor's house while the neighbors were out of town. He shot and killed both of the perps (Colombian "nationals"). The instructor used this case as an example of what not to do.

Even if the guy escaped prison, he would be using a substantial amount of his life savings paying lawyers to keep him out of jail, and would likely be sued by the perps' relatives. We were taught to use our weapons to defend ourselves and to not go looking for trouble. This Aubery guy who was shot may have been a scumbag, but a "citizen's arrest" that turned to a fatal shooting was not the answer.
