"Donald Trump's campaign lawyer promotes 'birther' conspiracy theory that Kamala Harris is NOT eligible to be VP because her parents were immigrants".

The Trump campaign's Senior Legal Advisor Jenna Ellis pushed a so-called 'birther' narrative Thursday that Kamala Harris isn't eligible to be vice president because her parents weren't citizens when she was born in Oakland, California.

'It's an open question, and one I think Harris should answer so the American people know for sure she is eligible,' Ellis told ABC News.

Ellis' views on the issue came to light after she retweeted a link to a 'birther' op-ed published on Newsweek's website Wednesday written by right-wing law professor John C. Eastman.

Eastman pointed to how Article 2 of the Constitution says only a 'natural born citizen' can serve as vice president and president, but suggests there's some interpretation of the 14th Amendment's Citizenship Clause that could exclude someone in Harris' situation.

He also argued that while the modern view of citizenship includes every person born on American soil, that belief started after Harris was born in 1964. 'Indeed, the Supreme Court has that anyone born on U.S. soil, no matter the circumstances of the parents, is automatically a U.S. citizen,' he also wrote.

Eastman had run as a Republican in 2010 for California attorney general, but lost his primary. Harris ultimately won the position as a Democrat.

Eastman's op-ed received tremendous backlash, with many pointing out that it echoed the conspiracy theory pushed by President Donald Trump and others during President Barack Obama's tenure.

Josh Chafetz, a professor at Georgetown University Law Center, called Eastman's interpretation of eligibility as 'racist nonsense,' in a FactCheck.org post on the controversy.

He got support from Howard Dean—in charge of the DNC—and Pelosi who had to ‘certify’ Obama since she was Speaker of the House.


What is interesting is the difference in the certification documents signed by Pelosi for HI and the other 49 states.

Look them up.

But if it adds doubt to someone - then fine. Go for it.

The question is whether this line of attack will sway more people to the Trump camp than it estranges from them. And is anyone who buys this argument already a Trump vote?

Natural born is not a birther conspiracy. It is in the Constitution as one of three requirements to be president.

McCain was born in Panamanian municipal hospital in Colon, Panama. This business about him having been born “on base” or in the Panama Canal Zone needs to end. He was born on foreign soil.

Probably the most important result of litigating this to its logical end between now and election day would be to put an end to the REPUBLICAN PARTY’S habit of promoting ineligible candidates for POTUS.

Maybe its true, maybe it isn’t. The one thing I do know is that in terms of public opinion and how the media will play it, this is a gigantic loser. There’s way too much good material against Biden and Harris to be wading into this type of crap that’s already backfired on us in previous elections.

Conversely, A child born to 2 US citizens on foreign soil, isn’t eligible either.

This applies to two of my daughters.

“Having said that, Harris, Cruz, Jindal, Haley, and Rubio are NOT natural born citizens. Neither is Obama.” exactamundo. My brother born abroad while my parents served, is not eligible. I used to joke about it in the 80’s with him at the dinner table. He knew it, not that he would ever be considered. lol

It's not a conspiracy theory, she's NOT eligible to be President. Her parents were here on Visa's, they were not American Citizens. Plain 'n simple as that.

This country does not have birthright citizenship. No country in the world does.

Then how come Obama was eligible to be POTUS when his father was never US citizen, and was actually was a Kenya citizen.
And his mother was a minor when Obama was born.

It matters not where McCain was born but the fact that both his parents were US citizens at the time of his birth. His father was active duty military stationed in Panama at that time. What US citizen would be willing to serve overseas if their children born there would not be considered NBC?
Harris’ issue as well as Cruz’s issue is the citizenship status of their parents at the time of their birth.

Jamaican law states that since her father was a Jamaican citizen at the time of her birth, she is automatically a Jamaican citizen.

Can you say dual citizenship. That should disqualifier her from being President or VP.
